29. CONFLICT WAIVER FOR OFFICE OF GENERAL LITIGATION SERVICES Having received independent legal advice and having been fully informed as to the potential ramifications of a conflict of interest, including a full disclosure of the risks associated with granting a waiver of the conflict, the Board hereby gives its informed consent and grants the Office of General Litigation Services (the “Office”) a waiver of conflicts of interest resulting from enforcement action and Notice of Violations initiated by Maricopa County Air Quality Department against the Maricopa County Solid Waste Department. The waiver allows the Office to advise and represent the Maricopa County Solid Waste Department in responding to the Notice of Violation issued by the Maricopa County Department of Air Quality relating to the Queen Creek Landfill, owned by the county. Also, the Board hereby gives its informed consent and waives any conflict of interest and authorizes the Office, in conjunction with the Air Quality Department, to select qualified outside counsel to represent the Air Quality Department relating to the Notice of Violation. Further, the Board waives any conflict that may exist relating to the Office continuing to advise and represent both the Solid Waste Department and the Department of Air Quality on other non-adverse matters.
