98. IMPACT STATEMENT FOR THE PROPOSED SUN VIEW ESTATES II IRRIGATION WATER DELIVERY DISTRICT 1) Pursuant to A.R.S. § 48-261 and § 48-263, receive the impact statement for the proposed Sun View Estates II Irrigation Water Delivery District and set a public hearing for 9:00 a.m., Wednesday, November 17, 2010. 2) Approve a bond in the amount of $250 to be filed with the Board by the persons proposing the district to cover costs incurred by the County if the district is not finally organized pursuant to A.R.S. §48-261(C). At the hearing on November 17th, the Board will hear those who appear for and against the proposed district and shall determine whether the creation of the district will promote public health, comfort, convenience, necessity or welfare. If the Board of Supervisors determines that the public health, comfort, convenience, necessity or welfare will be promoted, it shall approve the district impact statement and authorize the persons proposing the district to circulate petitions. The proposed district is located in the Sun View Estates II Subdivision Community in Phoenix bounded by 11th Avenue on the east, Montebello Avenue on the south,15th Avenue on the west and Bethany Home Road on the north and contains approximately 30 acres and 88 parcels. The Board of Supervisors will hear those who appear for and against the proposed district and shall determine whether the creation of the district will promote public health, comfort, convenience, necessity or welfare. If the Board determines that the public health, comfort, convenience, necessity or welfare will be promoted, it shall approve the district impact statement and authorize the persons proposing the district to circulate petitions. 71. PETITIONS FOR PROPOSED SUN VIEW ESTATES II IRRIGATION WATER DELIVERY DISTRICT Pursuant to A.R.S. § 48-3423, accept the petitions filed for the proposed Sun View Estates II Irrigation Water Delivery District as they have been determined to be signed by a majority of the owners of the acreage within the proposed district. A balance remains on the impact statement bond in an amount sufficient to cover the petition publishing and posting, requiring no additional bond, therefore set a hearing for the petitions to be held at 9:00 a.m., April 13, 2011 and order the Clerk of the Board to publish the petition and notice twice in a newspaper and post copies within the district at conspicuous places. At the hearing on April 13th, any land owner within the proposed district may appear and object to the organization thereof or to the proposed boundaries thereof or to the inclusion of his land therein. The Board will hear and consider all comments in favor and against the organization of the district and decide whether to approve or reject the organization of the district with the boundaries proposed in the petition or with modified boundaries. The proposed district is located in the Sun View Estates II Subdivision Community in Phoenix bounded by 11th Avenue on the east, Montebello Avenue on the south,15th Avenue on the west and Bethany Home Road on the north and contains approximately 30 acres and 88 parcels. 6. SUN VIEW ESTATES II IRRIGATION WATER DELIVERY DISTRICT Pursuant to A.R.S. §48-3423, convene the scheduled public hearing regarding the petitions filed for the proposed Sun View Estates II Irrigation Water Delivery District, as they have been determined to be signed by a majority of the owners of the acreage within the proposed district. Any land owner within the proposed district may appear and object to the organization thereof, or to the proposed boundaries thereof, or to the inclusion of his land therein. The Board will hear and consider all comments in favor and against the organization of the district and decide whether to approve or reject the organization of the district with the boundaries proposed in the petition or with modified boundaries. If the Board decides to proceed with the organization of the district the Clerk is directed to publish and post notice describing the boundaries and fix a date of May 20, 2011 in which written protest against the organization may be filed by owners of a majority of the acreage within the district. If no protest is filed, or if one is filed and found insufficient, an order establishing the district shall be entered and will include the appointment of the following three trustees of the district as set forth in the petition: David Grese Martin Jones Wendy Wonderley The proposed district is located in the Sun View Estates II Subdivision Community in Phoenix bounded by 11th Avenue on the east, Montebello Avenue on the south,15th Avenue on the west and Bethany Home Road on the north and contains approximately 30 acres and 88 parcels.
