28. AMENDED AND RESTATED BENEFITS PLANS Approve amendment and restatement of the Maricopa County Cafeteria Plan, the Maricopa County Accident and Health Insurance Premium Plan, the Maricopa County Health Care Plan, and the Maricopa County Dependent Care Plan (the “Benefits Plans”). The amendments and restatements to the Benefits Plans incorporate recent changes to federal law and reflect the changes to governance of the Benefits Plans as a result of the County’s January 26, 2011 adoption of the Declaration of Trust for Maricopa County, Arizona Self-Insured Benefits Trust Fund (the “Benefits Trust”). In particular the amended and restated Benefits Plans: • Change the definition of dependent in the Health Insurance Premium Plan and Health Care [FSA] Plan to include certain adult children of employees; • Limit health care reimbursement for medicines to prescription drugs and insulin; • Provide that the Benefits Plans comply with the Genetic Information Nondiscrimination Act of 2008; and • Provide that the Benefits Plans will be administered in accordance with the Benefits Trust.
