A-1. LIMITED PERMISSION TO TESTIFY FOR SPECIFIED ATTORNEYS Approve limited permission to allow Mr. Thomas K. Irvine, Mr. Wade Swanson, Mr. Richard Romley, and Mr. David Tierney (the “Attorneys”) to testify as a witness in the arbitration proceedings in the matter at issue between Maricopa County and Ogletree, Deakins, Nash, Smoak, and Stewart, PC. regarding the litigation history of any matters in recent years as set forth in public filings in which they acted as counsel for Maricopa County, as recently requested by Maricopa County Counsel. This limited permission to testify does not waive the attorney/client privilege as to any past, present or future representations of the County by the Attorneys and such permission is only for the limited purpose of providing limited testimony regarding the litigation history in recent years as set forth in public filings relevant to the disciplinary proceeding. Such waiver by Maricopa County for this limited purpose shall not waive the attorney/client privilege for any other purpose or proceeding. Similarly, such waiver does not waive any confidentiality requirements of discussions held in executive sessions as required by law. See A.R.S. § 38-431.03. (C-06-12-162-M-00)
