78. SETTING OF HEARING FOR THE PROPOSED E COUNTRY CLUB DR IRRIGATION WATER DELIVERY DISTRICT IMPACT STATEMENT 1. Pursuant to A.R.S. § 48-261 and § 48-263, set a hearing date to receive the impact statement for the proposed E. Country Club Dr. Irrigation Water Delivery District. The hearing date is set for Wednesday, September 19, 2018 at 9:30 a.m. 2. Pursuant to A.R.S. § 48-261(C), approve a bond in the amount of $50 to be filed with the Board by the persons proposing the district to cover cost incurred by the County if the district is not organized. The Clerk of the Board of Supervisors shall post a notice of the hearing in at least three conspicuous public places in the area of the proposed district and shall publish a notice twice in a daily newspaper at least ten days before the hearing. At the hearing on September 19, 2018, the Board will hear those who appear for and against the proposed district and shall determine whether the district will promote public health, comfort, convenience, necessity, or welfare. If the Board of Supervisors determines that the public health, comfort, convenience, necessity, or welfare will be promoted, it shall approve the impact statement and authorize the persons proposing the district to circulate petitions. The following is the legal description of the proposed irrigation water delivery district. Lots 3 through 24 of COUNTRY CLUB PLACE, a Subdivision of the Southwest Quarter of Section 28, Township 2 North, Range 3 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 9 of Maps, Page 24; EXCEPT any portion of said Lots that has been Dedicated as Right of Way; TOGETHER WITH That part of the Southwest Quarter of Section 28, Township 2 North, Range 3 East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona, described as follows: Beginning at the Northeast corner of Lot 10, of COUNTRY CLUB PLACE, according to Book 9 of Maps, Page 24, records of Maricopa County, Arizona; thence North 80 feet along the Easterly boundary line of said COUNTRY CLUB PLACE, Thence South 89 degrees, 59 minutes, 30 seconds West along a line 80 feet North of and parallel with the North line of said Lot 10 a distance of 140 feet to the intersection with the extension of the West line of said Lot 10, Thence South along said extension a distance of 80 feet to the Northwest corner of said Lot 10, Thence East along the North line of said Lot 10 to the True Point of Beginning; TOGETHER WITH That part of the Southwest Quarter of Section 28, Township 2 North, Range 3 East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona, described as follows: Beginning at the Northeast corner of Lot 8, of COUNTRY CLUB PLACE, according to Book 9 of Maps, Page 24, records of Maricopa County, Arizona; said corner being the Northwest corner of the parcel herein described, run thence East on a prolongation of the North line of Lot 8, COUNTRY CLUB PLACE, a distance of 31.58 feet; Thence South 46 degrees, 30 minutes, 30 seconds West along a line which is the Northeasterly projection of the Southeasterly Line of Lot 8, COUNTRY CLUB PLACE 43.58 feet to a point, said point being a corner of Lot 8, COUNTRY CLUB PLACE; Thence North 0 degrees, 05 minutes East along the East line of said Lot 8 a distance of 30 feet to the True Point of Beginning.
