9. PETITIONS HEARING FOR THE FORMATION OF THE PROPOSED EAST COUNTRY CLUB DR IRRIGATION WATER DELIVERY DISTRICT Pursuant to A.R.S. § 48-3423 and § 48-3424, convene the scheduled public hearing regarding the petitions filed for the formation of the proposed East Country Club Dr. Irrigation Water Delivery District, as they have been determined to be signed by a majority of the owners of the acreage within the proposed district. Pursuant to A.R.S. § 48-3424, any land owner within the boundaries of the proposed district may appear and object to the organization thereof, or to the inclusion of the land owners property therein. The Board will hear and consider all comments in favor or against the organization of the district and decide whether to approve or reject the organization of the district within the boundaries proposed in the petition or with modified boundaries. If the Board decides to proceed with the organization of the district, the Clerk is directed to publish a notice and post copies of the notice describing the boundaries of the proposed district and fix a date of November 28, 2018, a date not less than 20 days after the publications and postings are completed. Written protests against the organization may be filed by owners of a majority of the acreage with the proposed district boundaries. If no protest is filed, or if one is filed and found insufficient, an order establishing the district shall be entered and will include the appointment of the following three (3) Trustees of the district as set forth in the petition: Martha Carey-Lee Bob Karber Don Skypeck Lots 3 through 24 of COUNTRY CLUB PLACE, a Subdivision of the Southwest Quarter of Section 28, Township 2 North, Range 3 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 9 of Maps, Page 24; EXCEPT any portion of said Lots that has been Dedicated as Right of Way; TOGETHER WITH That part of the Southwest Quarter of Section 28, Township 2 North, Range 3 East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona, described as follows: Beginning at the Northeast corner of Lot 10, of COUNTRY CLUB PLACE, according to Book 9 of Maps, Page 24, records of Maricopa County, Arizona; thence North 80 feet along the Easterly boundary line of said COUNTRY CLUB PLACE, Thence South 89 degrees, 59 minutes, 30 seconds West along a line 80 feet North of and parallel with the North line of said Lot 10 a distance of 140 feet to the intersection with the extension of the West line of said Lot 10, Thence South along said extension a distance of 80 feet to the Northwest corner of said Lot 10, Thence East along the North line of said Lot 10 to the True Point of Beginning; TOGETHER WITH That part of the Southwest Quarter of Section 28, Township 2 North, Range 3 East of the Gila and Salt River Base and Meridian, Maricopa County, Arizona, described as follows: Beginning at the Northeast corner of Lot 8, of COUNTRY CLUB PLACE, according to Book 9 of Maps, Page 24, records of Maricopa County, Arizona; said corner being the Northwest corner of the parcel herein described, run thence East on a prolongation of the North line of Lot 8, COUNTRY CLUB PLACE, a distance of 31.58 feet; Thence South 46 degrees, 30 minutes, 30 seconds West along a line which is the Northeasterly projection of the Southeasterly Line of Lot 8, COUNTRY CLUB PLACE 43.58 feet to a point, said point being a corner of Lot 8, COUNTRY CLUB PLACE; Thence North 0 degrees, 05 minutes East along the East line of said Lot 8 a distance of 30 feet to the True Point of Beginning.
