8. PETITIONS HEARING FOR THE FORMATION OF THE PROPOSED ARDEN ESTATES IRRIGATION WATER DELIVERY DISTRICT Pursuant to A.R.S. § 48-3423 and § 48-3424, convene the scheduled public hearing regarding the petitions filed for the formation of the proposed Arden Estates Irrigation Water Delivery District, as they have been determined to be signed by a majority of the owners of the acreage within the proposed district. Pursuant to A.R.S. § 48-3424, any land owner within the boundaries of the proposed district may appear and object to the organization thereof, or to the inclusion of the land owners property therein. The Board will hear and consider all comments in favor or against the organization of the district and decide whether to approve or reject the organization of the district within the boundaries proposed in the petition or with modified boundaries. If the Board decides to proceed with the organization of the district, the Clerk is directed to publish a notice and post copies of the notice describing the boundaries of the proposed district and fix a date of August 21, 2019, a date not less than 20 days after the publications and postings are completed. Written protests against the organization may be filed by owners of a majority of the acreage with the proposed district boundaries. If no protest is filed, or if one is filed and found insufficient, an order establishing the district shall be entered and will include the appointment of the following three (3) Trustees of the district as set forth in the petition: Dan Millett David Orendac Bert Millett The legal description of the proposed irrigation water delivery district is as follows: Lots 1 through 49 of ARDEN ESTATES UNIT ONE, a Subdivision of the Northwest Quarter of Section 13, Township 1 North, Range 5 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 119 of Maps, Page 12; EXCEPT any part of said ARDEN ESTATES UNIT ONE lying within Lots 1 through 8 of CANTERBURY PLACE, a Subdivision of Lots 23 thru 25, and a portion of Lots 16 thru 18, & 22 of “ARDEN ESTATES UNIT ONE” according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 211 of Maps, Page 17; TOGETHER WITH Lots 32 through 44 of KIRK ESTATES, a Subdivision of the Northwest Quarter of Section 13, Township 1 North, Range 5 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 160 of Maps, Page 10; TOGETHER WITH Lots 3 through 6, and Lot 8, of CANTERBURY PLACE, a Subdivision of the Northwest Quarter of Section 13, Township 1 North, Range 5 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 211 of Maps, Page 17; EXCEPT that part of said Lot 8 of CANTERBURY PLACE described as follows: Beginning at the Southeast corner of said Lot 8; Thence North 50 Degrees 55 Minutes 50 Seconds West along the Southwesterly line of said Lot 8 a distance of 246.75 Feet; Thence North 27 Degrees 48 Minutes 40 Seconds East for a distance of 109.97 Feet; Thence North 89 Degrees 48 Minutes 47 Seconds East a distance of 143.80 Feet to a point on the East line of said Lot 8, Thence South 00 Degrees 47 Minutes 40 Seconds West along said East line, a distance of 254.58 Feet to the Point of Beginning.
