1. AMEND CONTRACT FOR THE SMALL BUSINESS SUPPORT PROGRAM Authorize and approve the Arizona Community Foundation (ACF) contract amendment to continue the administration of the Small Business Support Program. The initial program contract was approved by the Board on June 30, 2020 (C-06-20-573-M-00), for $22.5 million which included program disbursements to approved applicants along with ACF’s fee of 1.9% (not to exceed $500,000). On September 16, 2020, the Board approved changes to the CARES Act Budget (C-06-21-174-X-00) that included adding an additional $40 million to allow for the expansion of the existing small business program. The amended contract allows for ACF to continue managing the program and to receive an additional $40 million for program costs associated with eligible applicants; increases their fee from 1.9% to 3.25% (not to exceed $1,300,000) for the additional $40 million program cost; includes the businesses within the cities of Phoenix and Mesa as eligible applicants; extends the application period from October 2nd to October 30th; along with other minor administrative changes. CONTRACT AMENDMENT NO. 2 FOR THE SMALL BUSINESS SUPPORT PROGRAM Authorize and approve the Arizona Community Foundation (ACF) contract amendment No. 2 to allow for changes to the Statement of Work for the New Business Support Program. The initial program contract was approved by the Board on June 30, 2020 (C-06-20-573-M-00), for $22.5 million. On September 29, 2020 (C-06-20-573-M-00), the Board approved the contract amendment No. 1 to allow for an additiona l $40 million for the continued small business program along with changes to the scope of work. The contract amendment No. 2 allows for ACF to manage the New Business Support Program of which $5 million will be allocated from the $40 million (Amendment No . 1). In addition, decrease the additional $40 million to $39.5 million of which $500,000 will be allocated to the economic development program not managed by ACF. The Statement of Work for the New Business Support Program allows for small businesses to ap ply during the application period ending on October 30, 2020. The New Business Support Program will be available for businesses within Maricopa County that started prior to March 1, 2020 and had gross income of less than $400 thousand per month from Januar y 1, 2020, to the date of their application. Qualified applicants may receive up to $15,000 for operating deficiency which includes rent, leases, supplies, payroll, or other expenses required to continue operations. Contract Amendment No. 2 (New Business Support Program) was not executed, and the following terms and conditions supersede the agenda item submitted on September 29, 2020. The contract amendment No. 2 allows for ACF to manage the New Business Support Program of which $5 million will be allocated from the $40 million (Amendment No. 1). The Statement of Work for the New Business Support Program allows for small businesses to apply during the application period ending on November 13, 2020. The New Business Support Program will be available for businesses within Maricopa County that started prior to March 1, 2020 and the applicant will certify that they had gross income of less than $400 thousand per month from January 1, 2020, to the date of their application. CONTRACT AMENDMENT NO. 3 FOR THE SMALL BUSINESS SUPPORT PROGRAM Authorize and approve the Arizona Community Foundation (ACF) contract amendment No. 3 to increase the contract value from $61.5 to $71.5 million to fund a $10 million increase for the continued small business and new small business programs. The initial program contract was approved by the Board on June 30, 2020 (C-06-20-573-M-00), for $22.5 million. On September 29, 2020 (C-06-20-573-M-00), the Board approved the contract amendment No. 1 to add $40 million to the contract for the continued small business program along with changes to the scope of work. On October 21, 2020, the Board approved amendment No. 2 which allowed for ACF to manage the New Business Support Program in the amount of $5 million which was allocated from the $40 million contract increase (Amendment No. 1). This amendment also reduced the $40m to $39.5m. The Statement of Work for the New Business Support Program will be changed so that the $5 million can be used by either the small business or the new small business program.
