11. PETITIONS HEARING FOR THE FORMATION OF THE PROPOSED TONKA VISTA IRRIGATION WATER DELIVERY DISTRICT Pursuant to A.R.S. § 48-261, § 48-3423 and § 48-3424, convene the scheduled public hearing regarding the petitions filed for the formation of the proposed Tonka Vista Irrigation Water Delivery District, as they have been determined to be signed by a majority of the owners of the acreage within the proposed district. Pursuant to A.R.S. § 48-3424, any landowner within the boundaries of the proposed district may appear and object to the organization thereof, or to the inclusion of the landowners’ property therein. The Board will hear and consider all comments in favor or against the organization of the district and decide whether to approve or reject the organization of the district within the boundaries proposed in the petition or with modified boundaries. If the Board decides to proceed with the organization of the district, the Clerk is directed to publish a notice and post copies of the notice describing the boundaries of the proposed district and fix a date of June 28, 2022, a date not less than 20 days after the publications and postings are completed. Written protests against the organization may be filed by owners of a majority of the acreage with the proposed district boundaries. If no protest is filed, or if one is filed and found insufficient, an order establishing the district shall be entered and will include the appointment of the following three (3) Trustees of the district as set forth in the petition: Steve Caprara Leslie Kland Eddie Demosthenes The legal description of the proposed irrigation water delivery district is as follows: The South 35.50 Feet of Lot 1, and Lots 11 through 44, of TONKA VISTA, a Subdivision of the South half of the South half of the Northeast Quarter of the Southwest Quarter and the Southeast Quarter of the Southwest Quarter of Section 10, Township 2 North, Range 3 East, of the Gila and Salt River Base and Meridian according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 52 of Maps, Page 27; TOGETHER WITH That part of the West 20 feet of 20th Street, as shown on and dedicated by TONKA VISTA, according to the Plat of Record in the Office of the County Recorder of Maricopa County, Arizona, Recorded in Book 52 of Maps, Page 27; lying between the North line of the South 12.5 feet of Lot 25 of said TONKA VISTA and the North line of the South 172.5 feet of said Lot 25; EXCEPT that part of said South 20 feet described as follows: BEGINNING at the Southeast corner of said West 20 feet, Thence Westerly along the South line of said West 20 feet a distance of 10 feet, Thence Northeasterly to a point in the East line of said West 20 feet which bears 10 feet North of the POINT OF BEGINNING, Thence Southerly along said East line a distance of 10 feet to the POINT OF BEGINNING; as abandoned by RESOLUTION NO. 20735 of the City of Phoenix, recorded at 2008-0957665, records of Maricopa County, Arizona.
