43. DEANNEXATION FROM CITY OF MESA TO MARICOPA COUNTY Pursuant to A.R.S. §9-471.03(D), set a hearing for January 25, 2023, to determine if the public interest is served by de-annexing road right-of-way from City of Mesa jurisdiction to Maricopa County in accordance with City of Mesa proposed ordinance. Also, for the hearing, direct Maricopa County Department of Transportation (MCDOT) to prepare an analysis of the requested action. Right-of-way location: From Sossaman and Warner intersection to 1471.47 feet north. Supervisory District No. 2. At the hearing, if after reviewing the analysis and hearing those that may appear for or against the action, the Board determines that the public interest is served by this de-annex/annexation action, the Board shall file in the Clerk of the Board’s Office an ordinance setting forth the legal description of the public right-of-way and declare the return of the right-of-way contingent on the fulfillment of the additional conditions of the statute which would include setting a second public hearing on this matter. The Board action will result to add 0.0019 square miles to County ownership and enable the County to assume responsibility for road maintenance. (C-06-23-432-X-00)
