23. AMENDMENT TO LEASE AGREEMENT L-7418 WITH LUHR’S INVESTORS, LLC Approve and authorize the Chairman to execute, Amendment No. 2 to Lease Agreement L-7418 between Maricopa County, as Lessee, and Luhr’s Investors, LLC, as Lessor, successor Lessor to HHLuhrs, LLC, regarding leased space within the Luhrs Annex at 125 S. 1st Avenue in Phoenix, AZ. Amendment No. 2 to Lease Agreement L-7418 will: 1) extend the lease term by 88 months beginning January 1, 2020 through April 30, 2027 and provide for renewal options; 2) modify the current rental structure to become a Full Service Rent with no pass-through of operating expenses to County at a rate of $28.25 per square foot per year with $0.50 s.f. annual increases beginning month 18 and every 12 months thereafter; 3) remove Lessor’s right to terminate under certain circumstances; 4) adjust the number parking spaces and the fees; and 5) give Lessee a Lessor-provided Tenant Improvement Allowance.
