74. LEASE AGREEMENT WITH CITY OF PHOENIX FOR NEW GROUNDWATER MONITORING WELL Approve and authorize the Chairman to execute a Lease Agreement L-7476 with the City of Phoenix, a municipal corporation, (Lessor) for the installation and monitoring of a Groundwater Monitoring Well on Lessor’s property identified as Maricopa County Assessor Parcel Number (APN) 211-27-190, which is located within the Sonoran Preserve, Phoenix, Arizona; and authorize the Chairman to sign all other documents approved by legal counsel required as part of the Monitoring Well and associated permitted uses for the installation and operation of a groundwater monitoring well at the subject site. The initial term (the "Term") of this Agreement will be for a period of approximately (25) twenty-five years and it shall expire May 31, 2043 unless terminated earlier. As consideration for the use of Lessor's property, Lessee agrees to pay as rent, in equal annual installments, plus rental tax, the sums as follow: Lease Term Annual Rate Years 1-25 $2,400.00 $ plus rental tax Lessee, in accordance with a Consent Order docket # S-2-10, filed on January 19, 2010 between Lessee and the Arizona Department of Environmental Quality (ADEQ), Arizona law, and the requirements of the Resource Conservation and Recovery Act (RCRA), desires to install a groundwater monitoring well and all associated appurtenances (“Monitoring Well”) on Lessor’s property as part of implementing a Remedial Action Plan (RAP) for the Cave Creek Landfill. This monitoring well will be included into a network of four existing monitoring wells in the Sonoran Desert Preserve. These monitoring wells were installed under an access agreement with the Arizona State Land Department signed by the BOS on October 31, 2012 (C-18-09-058-8-00). This agreement was conveyed with the property to the City of Phoenix when the City acquired the land for the Sonoran Desert Preserve. This item is located in Supervisor District 3.
