43. AGREEMENT MC-10186 WITH THE U.S. GOVERNMENT FOR USE OF MARICOPA COUNTY’S COMMUNICATION SITE AT WHITE TANK MOUNTAINS Approve and authorize the Chairman to execute an agreement (MC-10186) with the United States (U.S.) Government, for U.S. Customs and Border Protection’s use of a Maricopa County communications site atop White Tank Mountains, without public auction pursuant to A.R.S. 11-252 (9). THIS ITEM REQUIRES THE UNANIMOUS CONSENT OF THE BOARD. The U.S. Government will pay the County $700 per month toward the cost of providing utility services to the subject communications site. The $700 per month fee may be increased on an annual basis based upon documented increases in operating expenses of the site. Increases are capped at 30% annually. The initial term of the Agreement is from October 1, 2010 through September 30, 2015. The agreement contains three (3) five-year renewal terms. Either party may terminate the agreement after September 30, 2011, with a 60-day written notice. (C-18-11-031-3-00)
