73. RESOLUTION TO DISCLAIM AND RENOUNCE SPECIAL WARRANTY DEED Approve and Adopt the Board Resolution renouncing any and all Maricopa County rights, interest, and/or title in or over the real property described as Tract A of the Anthem Equestrian Trailhead as stated in the Special Warranty Deed recorded as instrument number 20080416108 in the office of the Maricopa County Recorder; and authorize the Chairman to execute the attached Disclaimer of Real Property Interest and Renunciation of Special Warranty Deed and any other related documents as approved by the Board’s legal counsel required for the renunciation of any County rights, interest and/or title in or over the subject real property as purportedly conveyed to Grantee through the subject Special Warranty Deed. The Final Plat for Anthem Equestrian Trailhead stipulates that Tract A is to be maintained and owned by Anthem Community Council, Inc., an Arizona non-profit corporation. On May 12, 2008, Pulte Homes Corporation recorded a conveyance document naming Maricopa County as Grantee without acceptance by the Maricopa County Board of Supervisors. This Board action will disclaim any Maricopa County interest in the subject property and will renounce the subject Special Warranty Deed. (C-18-12-001-8-00)
