36. LICENSE AGREEMENT WITH D. L. WITHERS FOR CONSTRUCTION YARD Approve and authorize the Chairman to execute license agreement P-50197 between Maricopa County, the Maricopa County Public Finance Corporation, and the D.L. Withers Construction, L.C. (DL Withers) for temporary use by D.L. Withers of a portion of parcel APN 112-19-127 at the southeast corner of 7th Avenue and Jefferson Street, Phoenix, Arizona. Parcel APN 112-19-127 is controlled by Maricopa County through a lease-purchase agreement with the Maricopa County Public Finance Corporation. The purpose of the subject license agreement is to allow D.L. Withers permission to use a portion of the subject property to establish a construction lay-down yard, a site for construction offices, and a site for project parking during the construction of the new Maricopa County Office Building at the northwest corner of 5th Avenue and Jackson Street in Phoenix, Arizona. The term of the subject license agreement will be from February 15, 2012 through December 31, 2013. The new Maricopa County Office Building will be occupied by units of the Maricopa County Sheriff’s Office. (C-18-12-023-3-00)

47. AMENDMENT TO LICENSE AGREEMENT WITH D.L. WITHERS CONSTRUCTION, L.C. Approve and authorize the Chairman to execute Amendment No. 1 to License Agreement No. P-50197 with Maricopa County (“Licensor/Owner”) and D.L. Withers Construction, L.C., (Licensee) for use of the southeast corner of 7th Avenue and Jefferson Street in Phoenix, AZ as a laydown yard and for construction offices. Amendment No. 1 will extend the term of the agreement for two months commencing January 1, 2014 and expiring February 28, 2014 unless terminated earlier by either party upon a minimum thirty (30) day written notice. Amendment No. 2 will extend the term of the agreement for two (2) months commencing March 1, 2014, and expiring April 30, 2014, unless terminated earlier by either party upon a minimum thirty (30) day written notice.
