A-3. NEW HARQUAHALA GENERATING COMPANY LLC V. MARICOPA COUNTY, ET AL, TX2006-000379 The Board of Supervisors accepts and approves the terms of settlement in this case, as discussed in Executive Session on December 13, 2010, which requires the Plaintiff to pay the sum of $4.5 million (inclusive of interest and penalties) to Maricopa County as taxes due and owing for tax years 2007 through 2009, with additional terms and conditions as set forth in that certain letter dated November 23, 2010 from Kenneth J. Love, Assistant Attorney General to Paul J. Mooney, counsel for the Plaintiff, which is marked Exhibit A and is on file in the Office of the Clerk of the Board of Supervisors; further, authorizes Kenneth J. Love, counsel in this matter for Maricopa County, to sign a Consent Judgment in the above-captioned case consistent with the terms of Exhibit A. (C-19-11-033-M-00)
