34. SETTLEMENT REGARDING ATTORNEY FEES AND NON-TAXABLE COSTS IN THE MATTER OF MELENDRES V MARICOPA COUNTY, D.C. NO. CV-07-2513-PHX-GMS Approve the Settlement Agreement Re: Attorneys’ Fees and Non-Taxable Costs in the matter of Melendres v Arpaio, et al. Case No. CV-07-2513-PHX-GMS as approved by counsel and signed on September 15, 2016. Additionally, pursuant to A.R.S. 42-17106(B), approve the transfer of expenditure appropriation in the FY 2017 Revised Budget by the following budget adjustments: a) Decrease the expenditure appropriation for the Non-Departmental (D470) General Fund (100) Non-Recurring (0001) Contingency (4711) in the line "Unreserved Contingency" in the amount of NTE $4,489,295. b) Increase the expenditure appropriation in the Non-Departmental (D470) General Fund (100) MCSO Judgment Order Non Recurring (MEL1) by NTE $4,489,295. These actions will have a County-wide net impact of zero and they do not alter the budget constraining the expenditure of local revenue duly adopted by the Board pursuant to A.R.S. §42-17105. Also direct the Department of Finance to issue payment according to the Settlement Agreement, signed September 15, 2016 in Melendres v Arpaio, et al. CV-07-02513-PHX-GMS. Approval of this action will allow payment of the settlement agreement of plaintiffs’ claim for attorneys’ fees and non-taxable costs. (C-19-17-014-M-00)
