10. GRANT FUNDS FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION Approve receipt of grant funds from the Arizona Criminal Justice Commission (ACJC) through the FY 2018-2019 Drug, Gang, and Violent Crime Program in the amount of $765,853, which includes: $659,404 in Federal funds under CFDA 16.738 and $106,449 in State funds. This program requires a hard cash match of 25 percent, or $255,285. The total award is $1,021,138. These funds are for the enhancement of drug, gang, and violent crime prosecution. This grant agreement, ACJC number DC-19-027, commences on July 1, 2018 and will terminate on June 30, 2019. Authorize the Chairman to sign all documents related to these grant funds, as applicable. The grant funds, $765,853, may not be expended for any indirect costs which may be incurred by the Maricopa County Attorney's Office or Maricopa County for the administration of this grant (Agreement Page 6, Paragraph 35). The grant allows a 0% rate for indirect costs, or $0 that may be incurred by the County Attorney's Office or Maricopa County for the administration of this grant. The Maricopa County Attorney's Office's composite indirect cost rate for FY19 is 13.5%, or $103,390. The recoverable indirect cost of administering this grant is $0; the non-recoverable indirect cost is $103,390. Grant revenues are not "local revenues" for the purpose of the constitutional expenditure limitation, and therefore budget law does not prohibit the expenditure of these funds. This award agreement is in the amount of $1,021,138 and will be used to support the salaries and employee related expenses of ten prosecutors and one detective. These positions will be used to enhance the prosecution of drug, gang, and violent crime. This grant will expire at the end of the award period unless prior written approval for an extension has been obtained from the Arizona Criminal Justice Commission. There is no long term expectation of continued funding for this grant; however, funds have been awarded by the Arizona Criminal Justice Commission for this purpose since FY 1995, with the most recent funding for FY 2018. 19. AMENDMENT TO DRUG, GANG, AND VIOLENT CRIME CONTROL GRANT FROM THE ARIZONA CRIMINAL JUSTICE COMMISSION Approve the amendment to the grant agreement from the Arizona Criminal Justice Commission (ACJC) for the FY 2018-2019 Drug, Gang, and Violent Crime Program. The amendment to ACJC Grant Number DC-19-027 is required in order to comply with the provisions imposed by the Department of Justice (DOJ) related to notification and access requirements for the Department of Homeland Security (DHS). These requirements are part of the lawsuit, Chicago v. Sessions, that delayed the release of the FFY 2017 Byrne Justice Assistance Grant. The DOJ released the federal funding to those jurisdictions that were not part of the lawsuit but mandated compliance with the notification and access requirements. For any jurisdiction to receive federal funding from the Byrne Justice Assistance Grant, these two provisions must be included in the grant agreement. Authorize the Chairman to sign all documents related to this grant agreement. The original grant agreement that was previously approved by the Board of Supervisors on 6/27/2018 included two provisions related to amending the grant agreement. Provision number five included the ability to modify the agreement through a written amendment signed by the ACJC Director and the grantee. Also, provision number seven included a statement that ACJC may amend the agreement to reflect any additional special conditions imposed by BJA in the FFY 2017 Byrne JAG federal grant agreement.
