39. RATIFICATION OF PREVIOUS INSTRUCTION/ACTION REGARDING THE STATE OF ARIZONA’S ERRONEOUS CONVICTION STATUTES Pursuant to A.R.S. § 38-431.05, approve the ratification of previous instruction/action given in Executive Session on June 8, 2026, to the Maricopa County Attorney’s Office regarding the State of Arizona’s erroneous conviction statutes. A Verified Special Action Complaint was filed on September 17, 2026, by outside counsel for Plaintiff City of Tucson against the State of Arizona regarding the state’s erroneous conviction statutes. Maricopa County is also a named plaintiff. A detailed written description of the instruction/action to be ratified and a description of all prior deliberations, consultations, and decisions is posted in the Maricopa County Clerk of the Board’s Office.
