28. AUTHORIZATION TO APPLY FOR TRIAL GAMING FUNDS FROM THE PASCUA YAQUI TRIBE FOR THE BENEDICT'S GARDEN PROGRAM Pursuant to A.R.S. 5-601.02, authorize the application to apply for pass-through of 12% Indian Gaming Funds (Proposition 202 (2002)) from the Pascua Yaqui Tribe for the Benedict's Garden Program in an amount not-to-exceed $35,000. The grant period is for one year from the date of award. Upon award of grant funds an additional agenda item will be submitted to the Board of Supervisors for acceptance of grant funds and execution of all necessary documents which may include an IGA between Maricopa County and the Pascua Yaqui Tribe. Additionally, the acceptance agenda item will adjust the overall grant budget to accommodate these grants through a future reconciliation. Indirect costs are not applicable to Tribal Gaming Grants. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, therefore, expenditures of these revenues are not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. (C-20-12-020-G-00)
