A-1. CANCEL THE NOVEMBER 6, 2012 ELECTION FOR THE CREIGHTON SCHOOL DISTRICT AND APPOINT THE TWO INDIVIDUALS WHO QUALIFIED FOR THE BALLOT. Cancel the November 6, 2012 election for the Creighton School District and appoint the two individuals who qualified for the ballot, Annette Sexton-Ruiz and Jeanne M. Simmons, to two of the three open governing board positions. Also, declare vacant the third governing board position for the Creighton School District for which no person filed nominating petitions or a nomination paper as a write-in and allow the Maricopa County Superintendent of Schools to appoint in accordance with A.R.S. § 15-302(A). The Arizona Legislature offers an alternate procedure for electing the governing board members of a school district as defined under Titles 15 and 16 (A.R.S. § 16-410). If the total number of persons who file a nomination petition, or write in nomination paper, is equal to or less than the number of positions to be filled for each office to be elected at the General Election, the County Board of Supervisors is authorized to cancel the election. The Board of Supervisors is also authorized to appoint those persons who filed a nomination petition or write in nomination paper to serve as a governing board member for the respective term. An election may also be canceled after the ballots have been printed if one or more candidates have been disqualified. A.R.S. § 16-410(D). For the Creighton School District, two of the four candidates who filed nomination petitions were disqualified from appearing on the General Election ballot through a nomination petition challenge. As a result, there were only two candidates who qualified for the ballot for the three open positions for 4-year terms. Because the cancellation of the Creighton School District election will occur after the ballots have been printed, the results of any vote for that office shall not be canvassed. The Maricopa County Superintendent of Schools shall fill by appointment the one seat for which no person filed nominating petitions or a nomination paper as a write-in and declared vacant.
