A-2. CANCEL THE NOVEMBER 6, 2012 ELECTION FOR THE RIVERSIDE SCHOOL DISTRICT GOVERNING BOARD AND APPOINT DRISS CHERRAT Cancel the November 6, 2012 election for the Riverside School District governing board and appoint Driss Cherrat who qualified for the ballot for the two year term. The Arizona Legislature offers an alternate procedure for electing the governing board members of a school district as defined under Titles 15 and 16 (A.R.S. § 16-410). If the total number of persons who file a nomination petition, or write in nomination paper, is equal to or less than the number of positions to be filled for each office to be elected at the General Election, the County Board of Supervisors is authorized to cancel the election. The Board of Supervisors is also authorized to appoint those persons who filed a nomination petition or write in nomination paper to serve as a governing board member for the respective term. An election may also be canceled after the ballots have been printed if one or more candidates have been disqualified. A.R.S. § 16-410(D). For the Riverside School District, one of the two candidates who filed nomination petitions was disqualified from appearing on the General Election ballot through a nomination petition challenge. As a result, there was only one candidate who qualified for the ballot for the one open position for a 2-year term. Because the cancellation of the Riverside School District election will occur after the ballots have been printed, the results of any vote for that office shall not be canvassed. (C-21-13-005-7-00)
