8. LEASE AGREEMENT WITH APS FOR USE OF PARKING SPACE Approve and authorize the Chairman to execute Lease Agreement L-7486 (Lease) with Arizona Public Service Company (APS), for use of parking space on parcel APN 112-18-116 located at 702 South Montezuma Ave, Phoenix, Arizona, 85003. This Lease is to provide an additional parking area near Maricopa County Elections’ MCTEC Office to meet a portion of the parking demands for staff and volunteers working the upcoming Primary and General election which are scheduled from March 2020 through November 2022. The term of the Lease will commence upon full execution of the Lease and expire on February 28, 2021 and will automatically extend in month-to-month periods upon the same terms and conditions set forth in the Lease. The County will be responsible for ensuring the parking area is in compliance with applicable air quality rules and regulations. As consideration, the County will pay an annual rental fee of $12,000.00 ($1,000.00 per month) plus any applicable taxes, within thirty (30) days of the Commencement Date. If County continues to occupy the premises after February 28, 2021, County will be invoiced for monthly payments of $1,000.00 plus any applicable taxes. In addition to rent, County will be responsible to pay APS for two Phase I inspections of the property, the first within thirty (30) days of the Commencement Date of the Lease and the other, if required by APS, upon Lease termination. This Lease is subject to A.R.S. § 38-511 and may be terminated by either party at any time after expiration of the Initial Term upon thirty (30) days’ prior written notice to the other party. County may also terminate this Lease at the end of any fiscal year due to non-appropriation of funds without any penalty or liability to County. This is located in Supervisory District 5.
