11. LEASE AGREEMENT L-7503 WITH LYNN MORRISON, LLC Approve and authorize the Chairman to execute Lease Agreement L-7503 (Agreement) with Lynn Morrison LLC an Arizona limited liability company (Lessor), for use of a total of 5,900 square feet of retail space at the three locations listed below; and approve and authorize the Deputy County Manager for Maricopa County or the Real Estate Director for Maricopa County, each individually and separately, to administer this Agreement as appropriate and necessary, which authority includes but is not limited to, execution of Subordination, Non-Disturbance and Attornment, Estoppel, and Notice documents. This Agreement is for the purpose of providing additional polling locations for the upcoming 2020 Primary and General elections in order to meet the CDC’s recommended social distancing guidelines for staff, volunteers and citizens. The Agreement will commence upon signature of both parties and expire Six (6) months from that date. In addition to electric utility reimbursement, as consideration for the full-service lease, the County will pay electric , in equal monthly installments and within thirty (30) days of receipt of invoice, the sums as follows for these locations: Premises 1: Peoria Power Center (CTT Peoria Power LLC, an Arizona LLC) 10250 N. 91st Ave., Suite A 104, Peoria, AZ 85345 2,975 rentable square feet (“RSF”) $3,222.92 plus 2.3% rental tax Premises 2: Bell Canyon Pavilions (GTT Bell Canyon LLC, an Arizona LLC) 2814 W. Bell Rd., Suite 1490-1495, Phoenix, AZ 85053 2,925 rentable square feet (“RSF”) $3,168.75 plus 2.9% rental tax This Agreement is subject to A.R.S. § 38-511 and may be terminated by the Parties by mutual written consent. County may also terminate this Agreement at the end of any fiscal year due to non-appropriation of funds without any penalty or liability to County. Final approval to the form of the lease agreement is subject to review and final approval of the Maricopa County Attorney’s Office.
