48. AMENDMENT TO THE BOYS AND GIRLS CLUB EAST VALLEY LEASE FOR HEAD START Approve and execute Amendment No. 3 to Lease No. Agreement L-7339 (C-22-04-107-4-02) with The Boys and Girls Club of the East Valley, Inc., as Licensor, for the use of classroom space located at 44 North Oak, Gilbert, AZ. The purpose of this amendment is to extend the term (and set a new rental rate). The lease term is for five years at a cost of $425.00 per month. This amendment is effective from September 1, 2013 to August 31, 2018. This classroom and playground serves a total of 34 Head Start (HS) children, 3-5 years of age, through center-based services. The lease does not impact any County General funds. (C-22-04-107-4-03)

52. AMENDMENT TO LEASE AGREEMENT WITH BOYS AND GIRLS CLUB OF EAST VALLEY Approve and execute Amendment No 4 to Lease Agreement No. L-7339 with Boys & Girls Clubs of the East Valley, Lessor, for use of classroom space for the Head Start program, located at 44 North Oak Street, Gilbert, 85233, and delegate authority to both the Deputy County Manager for Maricopa County and the Real Estate Director to perform administrative actions, including execution of documents, and to periodically carry out the intent of the Lease. Amendment No. 4 (“Amd 4”) will extend the term of the existing lease 60 months, from September 1, 2018 to August 31, 2023, unless terminated earlier as provided for in the agreement. The monthly base rent during the lease extension remains unchanged at $425.00 plus rental tax. Janitorial, utilities and maintenance are Lessor paid. Amd 4 will update Notice information for both Parties and provide a Subordination Non-Disturbance Agreement form. All other terms and conditions remain unchanged. 41. AMENDMENT TO LEASE AGREEMENT WITH BOYS & GIRLS CLUB OF THE VALLEY, INC. Approve and execute Amendment No. 5 to Lease Agreement L-7339 with Boys & Girls Club of the Valley, Inc., for the use of the classroom consisting of approximately 740 square feet and playground facility located at 44 North Oak, Gilbert, Arizona to provide Head Start Services; and acknowledge Lessor’s entity name change from Boys & Girls Club of the East Valley to Boys & Girls Club of the Valley, Inc., as defined in their Agreement and Plan of Merger dated December 20, 2019 and Formal Record of Action dated March 6, 2020. This purpose of the amendment is to address the following: (A) amend alterations/improvements provisions; (B) approval of certain Lessee Tenant Improvements to remove sandbox, backfill and infill of the Premises, at a one-time cost of up to $5,500; (C) amend Notices; and (D) provide for lease administration authority. The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-511. Either Lessor or Lessee may terminate the Lease by giving not less than ninety (90) days prior written notice of termination to the other Party. All other terms and conditions remain the same.
