46. IGA WITH STATE OF ARIZONA DEPARTMENT OF COMMERCE, ENERGY OFFICE FOR LOW-INCOME HOME ENERGY ASSISTANCE PROGRAM Approve a revenue Intergovernmental Agreement (IGA) between State of Arizona, Department of Commerce, Energy Office (C043-10-03) and Maricopa County, administered by its Human Services Department, in the not-to-exceed amount of $1,196,336.00. The term of this contract is from date of signature of both parties to June 30, 2011. The purpose of this IGA is to provide Weatherization Assistance for low-income households under the U.S. Department of Energy, Low-Income Weatherization Assistance Program, hereinafter referred to as Low Income Home Energy Assistance Program (LIHEAP). FY 2010-11 Human Services Department estimated indirect cost rate is 16.1%. However, in anticipation of an approved FY2011 indirect cost rate, the current negotiated approved US Department of Health and Human Services indirect cost rate utilized is 16.2%. The total grant funds are $1,196,336.00, of which $1,076,700.00 is passed through to the sub-recipient and not subject to indirect cost recovery. The recoverable indirect cost of administering the grant is $16,590. Funding for this IGA is provided by the State of Arizona Department of Commerce Energy Office (C043-10-03) and will not impact the County General Fund budget. The overall budget will be adjusted as necessary to accommodate this contract through a future reconciliation. The sub-recipient, Foundation for Senior Living (SERIAL 09078-RFP), provides weatherization assistance to eligible households. (C-22-10-089-3-00)

59. AMENDMENT TO REVENUE AGREEMENT WITH STATE OF ARIZONA DEPARTMENT OF COMMERCE, ENERGY OFFICE FOR LOW-INCOME HOME ENERGY ASSISTANCE PROGRAM Approve an amendment to the revenue agreement between the State of Arizona, Department of Commerce, Energy Office (G043-10-03) and Maricopa County, administered by its Human Services Department, to add an additional $226,821.00, for a not-to-exceed total amount of $1,423,157.00. The term of this amendment is from July 1, 2010 to June 30, 2011. The term of the grant period is from July 1, 2010 to June 30, 2011 . The total amendment increase of $226,821.00 has not previously been awarded to the County. These funds will allow, on average, an additional 31 clients to obtain weatherization efficiency benefits to their dwellings. This amendment also adds “Indemnification” language to the Special Terms and Conditions and replaces Exhibit A – Budget with revised Exhibit A – Budget. The FY11 current approved Human Services Department indirect cost rate is 16.1%. The total grant funds are $226,821.00, of which $225,373.00 is passed through to the sub-recipient and is not subject to indirect cost recovery. Indirect costs are estimated at $201.00 and are fully recoverable. Funding for this amendment is provided by the State of Arizona Department of Commerce Energy Office (G043-10-03) and will not impact the County General Fund budget. This amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105.
