LEASE AGREEMENT WITH MAXWELL PRESCHOOLS FOR HEAD START CLASSROOM AND PLAYGROUND Approve a lease (L-7416) with Maxwell Preschools for the rental of one Head Start classroom and playground located at Maxwell Preschools, Suite 10, 1455 South Stapley Drive, Mesa, Arizona. The lease term is August 1, 2010 through May 30, 2015, at a cost of $500.00 per month. This action was submitted for review and approved by the Facility Review Committee on July 22, 2010. This classroom and playground will serve a total of 34 children, 3-5 years of age, through center based services. This is a new site this year for a Maricopa County Head Start classroom. 51. AMENDMENT TO SUB-LEASE AGREEMENT WITH MAXWELL PRESCHOOLS FOR HEAD START CLASSROOM AND PLAYGROUND Approve an Amendment No. 1 to sub-lease (L-7416) (C-22-11-017-1-00) with Maxwell Preschools for the continued rental of one Head Start classroom and playground located at Maxwell Preschools, Suite 10, 1455 South Stapley Drive, Mesa, Arizona. This amendment will allow the Head Start program to make playground improvements, at its expense, and extend the current lease term by three years with an option for an additional three-year renewal. The reason for this amendment is to ensure that any playground improvements made from the Head Start Base Grant funding are available to the program during the useful life of the improvement and that disposal of any improvements purchased from federal funds is in accordance with federal requirements. This amendment will become effective at the time of signature by the Chairman of the Board. The revised lease term is August 1, 2010 through May 30, 2018, at a cost of $500.00 per month. Funds will be provided from the Head Start/ EHS Base grant through its annual budget. No county funds will be expended. This action was submitted for review and approved by the Facility Review Committee on April 26, 2012. 37. EARLY TERMINATION OF SUB-LEASE WITH MAXWELL PRESCHOOL ACADEMY, LLC. Approve the early termination of Sub-Lease Agreement L7416 with Maxwell Preschool Academy, LLC, located at 1455 South Stapley, Suite 5-10, Mesa, AZ. Also direct Real Estate Services staff to give written notice to the Sub-Lessor, of early termination. Authorization for termination is listed in the Lease Agreement Section 28 which allows either Party to terminate the Agreement without cause at any time during the Agreement period upon giving ninety (90) days written notice to the other Party. County will vacate the property on or about August 4, 2016. The Sub-Lease with Maxwell Preschool Academy is utilized by the County’s Head Start program, the lease termination will allow for a new location where a Birth to Five Center will be established. 52. IMMEDIATE TERMINATION OF SUB-LEASE AGREEMENT WITH MAXWELL PRESCHOOL ACADEMY, LLC Approve the immediate termination of Sub-Lease Agreement L-7416 with Maxwell Preschool Academy, LLC, located at 1455 S. Stapley Dr., Suite 10, Mesa, AZ. The current Sub-Lease Agreement is scheduled for early termination August 18, 2016 (C-22-11-017-1-02). It is in the interest of both Parties that the Sub-Lease Agreement now be terminated immediately by mutual consent. (C-22-11-017-1-03)
