46. RELEASE OF OBLIGATIONS CONTAINED IN WARRANTY DEED FOR COMMUNITY DEVELOPMENT BLOCK GRANT FUNDS Approve the Release of Obligations Contained in Warranty Deed for property located within the City of Mesa. Maricopa County Community Development Block Grant Funds were utilized to purchase a property for a homeless shelter in 1991. Funds in the amount of $200,000 will be returned to the Maricopa County Community Development Block Grant program from the City of Mesa. In 1991, the City of Mesa with financial assistance from Maricopa County, City of Tempe, City of Scottsdale, and City of Chandler purchased property at 2254 West Main Street in Mesa. This property was used for a homeless shelter, a CDBG eligible activity. As part of the transaction, a warranty deed was attached to the property which requires that if the property is either sold or converted to a use for non-CDBG eligible activities, the City of Mesa must reimburse the above participating agencies for funds contributed to the project. On June 1, 2012, La Mesita Family Homeless Shelter (operated by A New Leaf) received a Low Income Housing Tax Credit award from the Arizona Department of Housing for a project at 2254 West Main in Mesa to build a new homeless shelter. In July, 2012, the City of Mesa sold the property to A New Leaf. After the property was sold, A New Leaf and the City of Mesa became aware of the deed restriction and were informed that signatures from agencies which contributed financially to the original purchase of the property are required on the Release of Obligations Contained in Warranty Deed.
