46. AMENDMENT TO LEASE AGREEMENT WITH SON RISE FAITH COMMUNITY CENTER, INC. Approve and execute Amendment No. 5 to Lease Agreement L-7457 with Son Rise Faith Community Center, Inc., for the use of leased premises located at 800 West Galveston St, Chandler AZ 85225 to provide Head Start Services. The purpose of the amendment is to address the following: (A) redefine premises; (B) modify and replace Exhibit “A”; (C) approve certain Lessee improvements at a cost not to exceed $350,000; (D) extend Lease term for ten (10) years from the Commencement Date of the Agreement; (E) provide an option to renew; (F) update and replace termination language; (G) modify rental and utility rates for a monthly rate of $6,080.25; and (H) allow for counterpart signatures. The Agreement is subject to termination pursuant to the provisions of A.R.S. 38-511. After five (5) years from the Commencement Date, either Lessor or Lessee may terminate the Lease by giving no less than 12-month’s prior written notice of termination to the other Party. All other terms and conditions remain the same. Upon Lessee’s acceptance of the Tenant Improvements as complete, the parties will execute the Memorandum of Commencement Date, in substantially the same format as the attached Exhibit “C” (“Commencement Date”), and the monthly rental rate shall increase to five thousand three hundred ninety-five dollars and 25/100 ($5,395.25) and the monthly utility reimbursement rate shall increase to six hundred eight five ($685.00) dollars for the duration of the Extension Period. The monthly Lease amount shall remain at $990 and $407 for utility reimbursement until the Memorandum of Commencement Date is fully executed. 53. AMENDMENT TO LEASE AGREEMENT (L-7457) WITH SON RISE FAITH COMMUNITY CENTER, INC. Approve and execute Amendment No. 6 to Lease Agreement (L-7457) between Maricopa County (County) and 800 West Galveston, LLC., for County’s use of leased classroom and playground space located at 800 West Galveston St, Chandler AZ 85225 to provide Head Start Services. The purpose of the Amendment is to: 1. extend the Lease retroactively, through May 31, 2033 (Term) Upon County’s receipt of a Certificate of Occupancy issued by the City of Chandler, a Fire Marshal’s non-violation inspection certificate, and acceptance of the Tenant Improvements, the parties will execute the Memorandum of Rate Increase, in substantially the same format as Exhibit “C” of the Fifth Amendment, the Premises will increase to 3,154 square feet of exclusive use and 2,289 square feet of non-exclusive use, and the monthly rental rate shall increase to five thousand three hundred ninety-five dollars and 25/100 ($5,395.25) and the monthly utility reimbursement rate shall increase to six hundred eight five ($685.00) dollars for the duration of the Term.
