23. AMENDMENT TO THE IGA WITH ARIZONA DEPARTMENT OF ECONOMIC SECURITY FOR COMMUNITY ACTION ACTIVITIES Approve revenue Amendment No. 14 to the Intergovernmental Agreement (Agreement) between Arizona Department of Economic Security (DES) and Maricopa County, administered by its Human Services Department. The purpose of Amendment No. 14 will address a reduction in funds from DES as follows: • Revise Section 32.0 (Levels of Service), the Case Management service reimbursement ceiling for the period of July 1, 2019 through June 30, 2020 is revised from $5,388,470 to $5,371,931.63, a decrease of $16,538.37. • Revised Case Management Service Budgets are added to the Agreement. The Agreement ceiling amount shall be changed from $6,289,777.75 to $6,273,239.38 a difference of $16,538.37. The reason for the decrease in funding is due to reconciliation of FY19 budget and FY20 carryforward funding. Except as provided in Amendment No. 14, all terms and conditions of the original Agreement and previous Amendments, remain unchanged and in full force and effect. The Amendment shall become effective on the date of last signature unless otherwise specified. DES contracts with the County on an annual reoccurring, non-competitive basis for service delivery of the Community Action program activities. Funds are utilized to provide assistance to eligible low-income residents in Maricopa County outside of the City of Phoenix and the City of Mesa. Assistance may include: eviction prevention services, rent, mortgage and utility assistance. The services provided under this Agreement are not a mandated function but provide a benefit to the citizens by providing eligible low-income residents with financial assistance. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This Amendment does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this Amendment through future budget reconciliation. The reduction of funds will not impact the County General Fund. AMENDMENT TO IGA WITH CITY OF AVONDALE FOR COMMUNITY ACTION PROGRAM ACTIVITIES Approve Amendment No. 4 to the financial Intergovernmental Agreement between the City of Avondale (“Subrecipient”) and Maricopa County, administered by its Human Services Department. The County contracts with the Subrecipient for the provision of Community Action program (CAP) activities such as crisis case management and financial assistance services for residents of the Central West Community Service Area. The purpose of Amendment No. 4 is to address the following: 1. Amend Section I (General Provisions), Paragraph E (Term/Effective Date/Renewal Life of the Agreement), Subparagraph 1, to add the following sentence: The Agreement may be extended for a fourth term not exceeding one year, upon written agreement of the parties. 2. Extend the Agreement termination date from June 30, 2020, to December 31, 2020. 3. The County shall provide the Subrecipient with $39,875 for the period of July 1, 2020, to December 31, 2020. 4. Incorporate an updated ATTACHMENT B - Operating Budget for the period of July 1, 2020 to December 31, 2020 into the Agreement. 5. Update the Points of Contact for the Agreement. 6. Revise Section I (General Provisions) by removing in its entirety Paragraph ZZ, regarding the County’s required ISRAEL BOYCOTT clause. 7. Revise Section I (General Provisions) to add Paragraph AAA FORCE MAJEURE clause. This Amendment is subject to the provisions of A.R.S. §38-511. The foregoing paragraphs contain all the changes made by this Amendment No. 4. All other terms and conditions of the Agreement remain in full force and effect as amended by Amendment Nos. 1, 2, and 3. The County is empowered by A.R.S. §§ 11-201, 11-251 and 11-952 to enter into this Amendment No. 4 and has delegated to the undersigned the authority to execute this Amendment No. 4 on behalf of the County. The Subrecipient is empowered by A.R.S. §§ 9-240, 9-500.11, 11-952, and 46-241, et seq. to enter into this Amendment No. 4 and has by resolution delegated to the undersigned the authority to execute this Amendment No. 4 on behalf of the Subrecipient. This Amendment No. 4 shall be effective upon approval and signature by both Parties. AMENDMENT TO IGA WITH CITY OF AVONDALE FOR COMMUNITY ACTION PROGRAM ACTIVITIES Approve Amendment No. 5 to the financial Intergovernmental Agreement between the City of Avondale (“Subrecipient”) and Maricopa County, administered by its Human Services Department. The County contracts with the Subrecipient for the provision of Community Action program (CAP) activities such as crisis case management and financial assistance services for residents of the Central West Community Service Area. The purpose of Amendment No. 5 is to address the following: 1. Increase Agreement funding in the amount of $178,997. Funding availability period is July 1, 2020 through December 31, 2020. 2. Funding for the period of July 1, 2020 through December 31, 2020 shall not exceed $218,872. a. $185,761 of the $218,872 is funding from the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) for the provision of rental and utility assistance services. 3. Extend the Agreement term to January 1, 2021 through June 30,2021. This Amendment is subject to the provisions of A.R.S. §38-511. The foregoing paragraphs contain all the changes made by this Amendment No. 5. All other terms and conditions of the Agreement remain in full force and effect as amended by Amendment Nos. 1, 2, 3 and 4. The County is empowered by A.R.S. §§ 11-201, 11-251 and 11-952 to enter into this Amendment No. 5 and has delegated to the undersigned the authority to execute this Amendment No. 5 on behalf of the County. The Subrecipient is empowered by A.R.S. §§ 9-240, 9-500.11, 11-952, and 46-241, et seq. to enter into this Amendment No. 5 and has by resolution delegated to the undersigned the authority to execute this Amendment No. 5 on behalf of the Subrecipient. This Amendment No. 5 shall be effective upon approval and signature by both Parties. The County and the City entered into a financial Intergovernmental Agreement in June 2017 for the provision of Community Action Program activities to assist low-income eligible residents with crisis case management and financial assistance services Funding for this Agreement is provided by an Intergovernmental Agreement with Arizona Department of Economic Security (ADES) under contract ADES15-089115 (C-22-15-064-3-00), Human Services Department’s appropriated General Funds, and the Coronavirus Relief Funds provided to Maricopa County. The purpose of Amendment No. 5 is to address the following: 1. Increase Agreement funding in the amount of $183,774. Funding availability period is July 1, 2020 through December 31, 2020. 2. Funding for the period of July 1, 2020 through December 31, 2020 shall not exceed $227,252. a. $195,562 of the $227,252 is funding from the Coronavirus Relief Funds from the Coronavirus Aid, Relief, and Economic Security Act (CARES Act) for the provision of rental and utility assistance services. 3. Extend the Agreement term to January 1, 2021, through June 30, 2021. This Amendment is subject to the provisions of A.R.S. §38-511.
