MEMORANDUM OF AGREEMENT BETWEEN MARICOPA COUNTY, ARIZONA DEPARTMENT OF HOUSING, THE ARIZONA STATE HISTORIC PRESERVATION OFFICER, THE ARIZONA STATE MUSEUM, THE CITY OF TEMPE, THE SALT RIVER PIMA-MARICOPA INDIAN COMMUNITY, AND VALOR ON EIGHTH, LLC Approve a non-financial Memorandum of Agreement (MOA) between Maricopa County, Arizona Department of Housing, the Arizona State Historic Preservation Officer, the Arizona State Museum, the City of Tempe, the Salt River Pima-Maricopa Indian Community, and Valor on Eighth, LLC. The MOA is required to meet the federal requirements of HOME Investment Partnerships Program funding received by U.S. Department of Housing and Urban Development (HUD). The County, as the Responsible Entity (RE) for the Maricopa HOME Consortium, is required to comply with HUD Environmental Review Regulations at 24 CFR § 58 [see 24 CFR § 58.5(a) and 24 CFR §58.1(b)(4)], and Section 106 of the National Historic Preservation Act (NHPA), as amended, 54 U.S.C. § 306108, and its implementing regulations, 36 CFR § 800 [see 36 CFR § 800.2(c)(2)]. As part of the required compliance with the above regulations, the County is entering into this MOA, which includes a Historic Properties Treatment Plan (HPTP). The HPTP will be implemented in order to avoid, minimize, and/or mitigate adverse effects on historic properties within the APE. The County will work with all parties to the MOA to ensure compliance with both the MOA and the HPTP. On or about June 24, 2015, Maricopa County, through its Human Services Department, entered into an Intergovernmental Agreement (IGA) with the City of Tempe (C-22-15-074-3-00) to provide $1,169,999.11 in HOME Investment Partnerships Program funds, of which $318,772 is allocated to the Valor project. Valor on Eighth, LLC (Valor) has proposed a project for the construction of a five-story, 50-unit rental community with affordable and market rate units located at 1001 East 8th Street, Tempe, AZ. The County has defined the property and parcels (132-73-012, 132-73-013, 132-73-014, and an area approximately 70‘ by 75’ at the SE corner of parcel 132-73-536) as an area of potential effect (APE). The City of Tempe is the current owner of the property and parcels. The property and parcels are present within an archaeological site known as “La Plaza”. (C-22-17-018-3-00)
