AMENDMENT TO THE IGA WITH THE TOWN OF GILA BEND FOR COMMUNITY DEVELOPMENT BLOCK GRANT ACTIVITIES Approve Amendment No. 1 to the Intergovernmental Agreement (“Agreement”) between the Town of Gila Bend (hereinafter referred to as the “Subrecipient”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Amendment is to increase the scope of work and the Agreement funding amount for the project. The scope of work will increase the reconstruction of Euclid Avenue from 361 linear feet to 780 linear feet and add new 4’ wide concrete sidewalks. Through this Amendment, the County will provide the Subrecipient with $143,620 U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds for project activities. The Agreement funding amount will increase from $121,296 to a not-to-exceed amount of $264,916. The Budget and Compensation sections of the Agreement will change to accommodate the Amendment funding. The purpose of Amendment No. 1 is to amend Section III (Work Statement), Paragraph 2.0 (Scope of Work), subparagraph 2.1 as follows: Project Description: The Subrecipient shall remove and replace approximately 11,673 square yards of asphalt on six (6), 30-foot streets from curb to curb. The streets are Calle Fortunato Serrano, Calle Juan Taeva, Calle Brigido Valenzuela, Calle Maximo Solarez, Ciculo S. Hernandez, and Jimenez Circle. Project activities shall also include the installation of new speed humps on the following streets: S. Calle Tomi and W. Calle SENU. The project will be located in within the Town of Guadalupe, AZ. The engineering design and installation of the work shall meet Maricopa Association of Governments (MAG) Standards and locally adopted codes. The Amendment now includes the installation of speed humps to 2 streets: S. Calle Tomi and W. Calle SENU. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. The purpose of the Agreement is for the City of Chandler to provide single-family owner-occupied housing reconstruction and tenant based rental assistance programs. The County provided the City with U.S. Department of Housing and Urban Development (HUD) for HOME Investment Partnerships Program (HOME) activities. The Parties agree to enter into this Amendment No. 3 to the Agreement to amend the Agreement as follows: A. Add additional Work Statement, hereinafter referred to as “2019 Work Statement A” for the City to acquire, rehabilitate and resell a single-family home. The County shall provide the City with $141,585.00 in 2019 HOME funds for this Work Statement. The expenditure timeframe for the 2019 Work Statement A shall be through September 30, 2023. B. IGA WITH TOWN OF GUADALUPE FOR COMMUNITY DEVELOPMENT BLOCK GRANT ACTIVITIES Approve an Intergovernmental Agreement (“Agreement”) between the Town of Guadalupe (hereinafter referred to as the “Subrecipient”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the Subrecipient to provide temporary accommodations for COVID positive residents as well as purchase supplies for meal preparation, storage, and delivery for vulnerable and senior residents of Guadalupe, AZ. The supplies will include food, containers, personal protective equipment, and cleaning supplies. The County will provide the Subrecipient with U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funds authorized by the CARES Act in the amount not-to-exceed $26,216.00. The COVID-19 pandemic has increased the cost of delivery of essential public services, in a safe manner, to vulnerable residents of Guadalupe in two key areas: 1) Community Action Program (CAP) food distribution and 2) Senior Center home delivery and daily “to-go” meals to our Elders. The demand for food distribution has increased, and the senior meals can no longer be served at the Senior Center. Agreement term shall begin July 1, 2020 and will expire July 1, 2021. Also request authorization for the Human Services Department Director to approve and execute Change Orders/Administrative Changes as listed below: Pursuant to Section II Special Provisions paragraph 12.0 ADDITIONAL CERTIFICATIONS AND WARRANTIES subparagraph 12.1.18. Changes – The County may, at any time, by written Change Order/Administrative Change executed by the Director of the Human Services Department, make changes within the general scope of this Agreement in any one or more of the following areas: 12.1.18.1 Modifications to the project implementation schedule as long as it does not extend or shorten the term of the Agreement; 12.1.18.2 Minor changes in the Work Statement, provided the overall scope of work for the project is unchanged; 12.1.18.3 Value engineering of the work, provided that the change is made only to reduce the cost of the project and not to reduce the scope of work, and that the overall scope is not changed; 12.1.18.4 Modifications to terms consistent with any changes required by Federal, State, or County regulations ordinances or policies; and 12.1.18.5 Modifications to administrative requirements such as changes in reporting periods, frequency of reports, or report formats required by HUD or local regulations, policies or requirements. RECEIPT OF CARES ACT FUNDS FROM THE U.S. DEPARTMENT OF HOUSING AND URBAN DEVELOPMENT AND AMENDMENT TO THE FY2019-20 ANNUAL ACTION PLAN FOR HUD FUNDED PROGRAM ACTIVITIES Approve the following actions: 1. Approve receipt of a second Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136 funding allocation from the U.S. Department of Housing and Urban Development (HUD) for Emergency Solutions Grants (ESG-CV) in the amount of $2,815,627; and 2. Approve the submittal of Amendment No. 2 to the FY2019-20 Annual Action Plan (AAP) to HUD. The AAP identifies the activities to be conducted with the CARES Act funds as identified in Attachment A: a. Rapid Rehousing services, Shelter, and Program Administration. The County received notification from HUD that a second allocation of ESG-CV CARES Act funding, also referred to as ESG-CV2 in HUD documents, was awarded to the County. These special ESG-CV funds are to be used to prevent, prepare for, and respond to the coronavirus pandemic (COVID-19) among individuals and families who are homeless or receiving homeless assistance; and to support additional homeless assistance and homelessness prevention activities to mitigate the impacts of COVID-19. The HUD notifications lists that “The funds may be used to cover or reimburse allowable costs incurred by a State or locality before the award of funding (including prior to the signing of the CARES Act) to prevent, prepare for, and respond to COVID-19” and does not list an end date for the period of availability. HUD notified the County that it would need to make a Substantial Amendment to its 2019 Annual Action Plan in order to add these new funding sources. Further clarification and direction are provided in the HUD notifications and will be subject to any additional applicable regulatory waivers, funding flexibilities, or conditions as granted or allowed by HUD. The funding allocation is one-time funding and was awarded to the County through a non-competitive process. Also request authorization and approval for the Human Services Department Director to sign any documents required by HUD for this funding allocation. HUD funded activities are administered by the Maricopa County Human Services Department, Housing and Community Development Division. The services to be provided by the grant funds are not mandated services but will benefit County residents by providing services to alleviate the impact of COVID-19 pandemic for those experiencing homelessness. Receipt of the funds do not require match funds or future or ongoing contributions at the end of the funding availability period. The Human Services Department FY2020 approved provisional indirect cost rate is 22.2% from the U.S. Department of Health and Human Services for salaries and employee related expenses. The total allocated funds are $2,815,627 of which $230,410.80 is for salaries and benefits. The total estimated indirect costs are $51,151.20 and fully recoverable. Budget adjustments will be made when the Indirect rate costs has been fully negotiated and shall be effective as of April 2, 2020. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore expenditure of the revenues is not prohibited by the budget law. The approval of this funding does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant A.R.S. §42-17105. Approval of this item shall not impact the County General Fund. The overall grant budget will be adjusted as necessary to accommodate this grant through a future grant reconciliation. 42. AMENDMENT TO THE FY2019-20 ANNUAL ACTION PLAN FOR HUD FUNDED PROGRAM ACTIVITIES Approve the following actions: 1. Approve the reallocation of Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136 - Community Development Block Grant Coronavirus (CDBG-CV), second funding allocation from the U.S. Department of Housing and Urban Development (HUD). The (CDBG-CV) funding reallocation amount is $2,000,000; and 2. Approve the submittal of Amendment No. 4 to the FY2019-20 Annual Action Plan (AAP) to HUD. The AAP identifies the activities to be reallocated with the CDBG-CV funds as identified in Attachment A. 3. Also request authorization and approval for the Human Services Department Director to sign any documents required by HUD for this funding allocation. 70. AMENDMENT TO THE FY2019-20 ANNUAL ACTION PLAN FOR HUD FUNDED PROGRAM ACTIVITIES Approve the following actions: 1. Authorize the Maricopa County Human Services Department (MCHSD) to reallocate Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136 Emergency Solutions Grant Program - funding (ESG-CV) from the U.S. Department of Housing and Urban Development (HUD). Maricopa County received $905,900 in ESG-CV funds on August 27, 2020, and $2,815,627 (ESG-CV2) on November 23, 2020. Total ESG CV funds received is $3,721,527. The reallocation is: a. Rapid Rehousing from $1,905,784 to $1,420,861 b. Temporary Shelter Assistance from $1,367,181 to $1,777,104 c. Homeless Management Information System (HMIS) from $100,000 to $175,000 d. MCHSD Administration $348,562 unchanged 2. Approve MCHSD to submit a revised 2019-2020 Annual Action Plan Amendment No. 5 to HUD detailing the ESG-CV funding reallocation in Attachment A. 3. Also request authorization and approval for the Human Services Department Director to sign any documents required by HUD for this funding reallocation. Approval of the reallocation of funds does not impact the previously received ESG-CV funding amount of $3,721,527. Approval of this item shall not impact the County General Fund.
