37. AMENDMENT TO IGA WITH CITY OF TOLLESON FOR COMMUNITY ACTION PROGRAM ACTIVITIES Approve Amendment No. 6 to the financial Intergovernmental Agreement between the City of Tolleson (“Subrecipient”) and Maricopa County, administered by its Human Services Department. The County contracts with the Subrecipient for the provision of Community Action program (CAP) activities such as crisis case management and financial assistance services for residents of the Tolleson Community Service Area. The purpose of Amendment No. 6 is to address the following: A. The County shall provide the Subrecipient with funding for programs strictly related to the Subrecipient’s increase in number of COVID-19 cases within its jurisdiction. B. Funding for this Amendment is provided by Catalog of Federal Domestic Assistance (CFDA) 21.019 Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public Law 116-136. C. Community Action Program funding and activities shall include: 1. $40,000 for temporary staff and $10,000 for temporary staff to assist COVID-impacted residents connect to a procured hotel, a not-to-exceed amount of $50,000 and to provide assistance to eligible residents. D. Cultural Health Advocates project funding and activities shall include: 1. $80,000 for temporary, full or part-time Cultural Health Advocates to assist the City and the County in promoting effective COVID mitigation and prevention and provide information to special populations within the City. The foregoing paragraphs contain all the changes made by this Amendment No. 6. All other terms and conditions of the Agreement remain in full force and effect as amended by Amendment Nos. 1, 2, 3, 4, and 5. The County is empowered by A.R.S. §§ 11-201, 11-251, and 11-952 to enter into this Amendment No. 6 and has delegated to the undersigned the authority to execute this Amendment No. 6 on behalf of the County. The Subrecipient is empowered by A.R.S. §§ 9-240, 9-500.11, 11-952, and 46-241, et seq. to enter into this Amendment No. 6 and has by resolution delegated to the undersigned the authority to execute this Amendment No. 6 on behalf of the Subrecipient. This Amendment No. 6 shall be effective upon approval and signature by both Parties. FY2021: $130,000 Expenditures Supervisor District: 5 (C-22-16-042-3-06)

42. AMENDMENT TO IGA WITH CITY OF TOLLESON FOR COMMUNITY ACTION PROGRAM ACTIVITIES Approve Amendment No. 9 to the financial Intergovernmental Agreement between the City of Tolleson and Maricopa County, administered by its Human Services Department. The County contracts with the City for the provision of Community Action program (CAP) activities such as crisis case management and financial assistance services for residents of the Central West Community Service Area. The purpose of Amendment No. 9 is to address the following: 1. Amendment No. 3 of the Agreement revised the City’s title from “Contractor” to “Subrecipient” and added audit and contract requirements. The County is now reverting the title to “Contractor” and removing any reference to “Subrecipient” for this Agreement. Revising the title to Contractor requires changes to the following areas: a. Section I (General Provisions), paragraph GG (Agreement Compliance Monitoring) by removing in its entirety and replacing with revised contract language. b. Correct error in Amendment No. 3 which incorrectly referenced Paragraph M (Disallowed Costs) in Section 2 (Special Provisions). This correction will correctly recognize Paragraph N (Disallowed Costs). c. Revise Section II (Special Provisions), paragraph N (Disallowed Costs) to remove Subrecipient reference and replace with Contractor, throughout paragraph. d. Correct error in Amendment No. 3 which incorrectly referenced Paragraph N (Payment Recoupment) in Section II (Special Provisions). This Correction will correctly recognize Paragraph O (Payment Recoupment). e. Revise Section III (Work Statement), paragraph B (Training) remove Subrecipient reference and replace with Contractor, throughout paragraph. f. Revise Section IV (Compensation) to remove Subrecipient reference and replace with Contractor. 2. The title of Contractor and revisions to the Agreement shall be retroactive to July 1, 2021. 3. Changes made by this Amendment No. 9 shall also be reflected in Amendments No. 4, 5, 6, 7 and 8. The foregoing paragraphs contain all the changes made by this Amendment No. 9. All other terms and conditions of the Agreement and approved Amendments remain in full force and effect. This Amendment No. 9 shall be effective upon approval and signature by both Parties.
