74. LEASE AGREEMENT WITH VALOR ON EIGHTH, LLC. Approve, and authorize the Chairman to execute financial Lease No. L-7474 between Maricopa County (Lessee) and Valor on Eighth, LLC., a Wisconsin limited liability company registered to do business in Arizona (Lessor), for exclusive use of 1,535 square feet of office/classroom and playground space at Valor on 8th housing complex located at 1001 East 8th Street, Tempe, AZ. This classroom and playground area will be utilized by the Head Start program to provide services to children ages 0-5 years of age. The Lease term is five (5) years, commencing July 1, 2018 to June 30, 2023, with an option to renew for two (2) additional five (5) year terms upon mutual consent. The County shall pay: • $1.00 per year for Base Rent; • $100 per month for utilities for the period of July 1, 2018 through June 30, 2019; • Up to $500 per month for utilities for the period of July 1, 2019 to June 30, 2020; • from July 1, 2020 through July 31, 2023 the County shall pay the County’s Proportionate Share of the actual cost of utilities consumed The Lessor shall make improvements to the building structure and surrounding area as depicted in Exhibit “D”, to accommodate State Child Care Licensing requirements for the Head Start program. The County will reimburse Lessor up to $20,000.00 for improvements to bring the facility into State required compliance. The Human Services Department will submit for Board of Supervisor approval, any changes to payments to be made to Lessor for utility payments during the term of July 1, 2020 through July 31, 2023. EARLY TERMINATION OF WITH VALOR ON 8TH, LLC., LEASE L-7474 Approve and authorize the termination of Lease L-7474 between Maricopa County (Lessee) and Valor on Eighth, LLC., a Wisconsin limited liability company (Lessor) and execute all necessary documents to terminate the Lease. Lessor and Lessee may collectively be referred to herein as the “Parties”, or individually as a “Party”. The Parties entered into Lease L-7474 for the Maricopa County Head Start program to have exclusive use of 1,535 square feet of office/classroom and playground space at Valor on Eighth’s housing community located at 1001 East 8th Street, Tempe, AZ. The Parties are mutually agreeing to terminate the Lease effective August 22, 2018 or upon the Board of Supervisor’s approval, whichever is the latter. The Lease was approved by the Board of Supervisors on June 27, 2018 (C-22-18-044-1-00) and fully executed by Val or on Eighth on July 27, 2018. Supervisory District: 2 (C-22-18-044-1-01)
