40. AMENDMENT TO THE AGREEMENT WITH ARIZONA DEPARTMENT OF HOUSING FOR RENTAL/EVICTION PREVENTION PROGRAM Approve revenue Amendment No. 1 to the Agreement between Arizona Department of Housing (ADOH) and Maricopa County, administered by its Human Services Department (County). The purpose of Amendment No.1 is for ADOH to provide the County additional funds from the State Housing Trust Funds (HTF) and the State Crisis Contingency Safety Net Funds to provide Rental/Eviction Prevention Assistance Program services to eligible individuals and families who are experiencing economic hardship due to the COVID-19 pandemic. The funding amount shall be increased by $752,264. The Amendment addresses the following: • The Purpose of this Amendment is to revise the funding allocations for the period of March 27, 2020 through December 31, 2020 as follows: • Increase funding from State Housing Trust Funds (HTF) from $464,250 to $964,250, an increase of $500,000 for Rental Assistance for the purpose set forth in the Scope of Work based upon funding available to ADOH under the Eviction Prevention Program related to COVID-19 Assistance. • Provide $252,264 from the State Crisis Contingency Safety Net Fund to deploy 10 full time employees to deliver program services. Funds will be utilized to provide rental assistance to eligible residents in Maricopa County (excluding the cities of Phoenix, Glendale, and Mesa) who have been economically impacted by the COVID-19 pandemic. The Human Services Department utilizes the provisional indirect rate of 22.2% by the U.S. Department of Health and Human Services FY2021 for salaries and employee related expenses. The total Amendment funds are $752,264 of which $206,435 is for salaries and benefits. The total estimated indirect costs are $45,829 and fully recoverable. Receipt of the funds from ADOH does not require in-kind or match funds and no future or ongoing contributions by the County at the end of the Agreement term. The services provided under this Agreement are not a mandated function, but provide a benefit to the citizens by providing eligible residents with rental assistance for eviction prevention. Grant revenues are not local revenues for the purpose of the constitutional expenditure limitation, and therefore, expenditure of the revenues is not prohibited by the budget law. This agreement does not alter the budget constraining expenditures of local revenues duly adopted by the Board pursuant to A.R.S. 42-17105. The overall grant budget will be adjusted as necessary to accommodate this Amendment through future budget reconciliation. Acceptance of this Amendment will not impact the County General Fund.
