75. SUBRECIPIENT AGREEMENT WITH NATIVE AMERICAN CONNECTIONS FOR EMERGENCY SHELTER SERVICES Approve a financial (“Agreement”) between Native American Connections, a community based non-profit organization and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the County to provide Native American Connections with Community Development Block Grant funds in the amount not-to exceed $144,670 for the provision of Emergency Shelter services. The agreement term is July 1, 2020 and will expire June 30, 2021. The Agreement shall become effective upon approval and signature by both Parties. Also request approval for the Human Services Department Director to approve and execute changes as listed below: Pursuant to Section II Special Provisions paragraph 4.0. BUDGET ADJUSTMENTS, CHANGE ORDERS AND AMENDMENTS: 4.3 Notwithstanding the foregoing, the Parties may agree to make non-substantive changes through written Administrative Change Orders, executed by the Human Services Department Director or designee and the Subrecipient in any of the following areas: 4.3.1 Work Statement activities which do not Increase or decrease the amount of total Agreement funding: 4.3.2 Changes to modify the project timeline as long as the last day of the project timeline is within the end date of the Agreement; 4.3.3 Modify terms consistent with any change to the Work Statement required by federal, state, or County regulations ordinances or policies; 4.3.4 Changes to budget line items within a 10% change in a category as long as the change does not result in an increase or decrease in the total contract budget amount, and 4.3.5 Administrative requirements, such as reporting format quality or quantity (or both), as required by the funding source or the County’s regulations, policies, or requirements. 4.3.6 All Administrative Change Orders will be reviewed and approved by legal counsel. 4.3.7 All executed Administrative Change Orders shall be incorporated into the Agreement. Change Orders/Administrative Changes will receive legal review and will be filed with the Clerk of the Board’s office upon full execution. This Agreement is funded by grants from the U. S. Department of Housing and Urban Development (HUD). Funding is included in the FY2021 budget and does not impact the General Fund. Supervisor District: 2 (C-22-20-058-3-00)

64. AMENDMENT TO AGREEMENT WITH NATIVE AMERICAN CONNECTIONS FOR EMERGENCY SHELTER SERVICES Approve Amendment No. 1 to the Agreement between Native American Connections, a community based non-profit organization and Maricopa County administered by its Human Services Department. The purpose of the Amendment is to address the following items: 1. The County shall provide the Subrecipient with a not-to-exceed amount of $105,201 in Coronavirus Aid, Relief, and Economic Security Act (CARES Act) funding to increase homelessness services. The funds must be expended no later than September 30, 2020. 2. Revise Section 3 (Work Statement) in the following areas: 1.3.1.5 Maintain an unusual incident log and contact the County via email and phone within two (2) hours of any unusual incident that requires escalation per the Subrecipient’s internal policy and procedures. The County’s point of contract is the County’s representative listed on page 1 of the Agreement. 3. Add to Section 3 (Work Statement): 2.0 COVID-19 Emergency Shelter Services 2.1 The Subrecipient shall: 2.1.1 Provide operation of emergency shelter services for homeless individuals experiencing homelessness in Maricopa County in an effort to protect them from exposure to COVID-19; 2.1.2 Provides services at the Travel Lodge, 600 West Van Buren Street, Phoenix, Arizona 85003; 2.1.3 Start the services on July 1, 2020, and continue them through September 30, 2020; and 2.1.4 Provide oversight and supervision of the County procured Security Guards to include: 2.1.4.1 Monitoring work activities; 2.1.4.2 Providing direction; and 2.1.4.3 Approving timecards. 4. Revise Section 5 (Attachments) to add Attachment 1-A CARES ACT MONTHLY BUDGET. The foregoing paragraphs contain all the changes to the Agreement made by this Amendment No. 1. All other terms and conditions of the Agreement shall remain unchanged and in full force and effect as executed by the Parties. The purpose of the Amendment is to address the following items: 1. The County shall provide the Subrecipient with a not-to-exceed amount of $105,201 in CARES Act funding for the period of December 31, 2020, through March 31, 2021. The monthly invoices shall not exceed $35,067. 2. The Subrecipient shall submit a final CARES Act invoice no later than April 10, 2021. 3. Revise Section 3 (Work Statement), Paragraph 2.0 (COVID-19 Emergency Shelter Services), Sub-subparagraph 2.1.3, by replacing it with the following: 2.1.3 Start the services on July 1, 2020, and continue them through March 31, 2021. The foregoing paragraphs contain all the changes to the Agreement made by this Amendment No. 4. All other terms and conditions of the Agreement and Amendment No. 1, Amendment No. 2 and Amendment No. 3 shall remain unchanged and in full force and effect as executed by the Parties. The purpose of the Agreement is to provide emergency shelter services for individuals and families experiencing homelessness in Maricopa County. The purpose of the Amendment is to address the following items: 1. The County shall provide Subrecipient with an additional not-to-exceed amount of $105,201 in American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds (CSLFRF) under the CFDA number of 21.027 to continue Hotel Shelter operations for the period October 1, 2021, to December 31, 2021. 2.Revise Section 1 (General Provisions), 52.0 (SUBRECIPIENT EMPLOYEE WHISTLEBLOWER RIGHTS AND REQUIREMENT TO INFORM EMPLOYEES OF WHISTLEBLOWER RIGHTS) to address the Whistleblower Rights process. 3. AMENDMENT TO AGREEMENT WITH NATIVE AMERICAN CONNECTIONS FOR EMERGENCY SHELTER SERVICES Approve Amendment No. 9 to the Agreement between Native American Connections (Subrecipient), a community based non-profit organization and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is to provide emergency shelter services for individuals and families experiencing homelessness in Maricopa County. The County and the Subrecipient collectively are referred to here as the “Parties.” The purpose of the Amendment is to address th e following items: 1. Extend the Agreement termination date from July 1, 2022 through June 30, 2024. 2. The County shall provide Subrecipient with a not-to-exceed amount of $144,670 in U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant (CDBG) funding under Assistance Listing Number (ALN) 14.218.
