70. COMPETITION IMPRACTICABLE CONTRACT WITH CIRCLE THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS Approve a financial Competition Impracticable Contract (“Agreement”) between Circle the City a community-based organization (“Contractor”) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the Contractor to provide patient care services to individuals experiencing homelessness who are COVID-19 positive or symptomatic at the County temporary housing facility located at 600 West Van Buren Street, Phoenix, Arizona, 85003. The County shall provide the Contractor with $955,584 for the term of the Agreement. The term of the Agreement shall begin on May 11, 2020 and shall expire on September 30, 2020. The Agreement may be renewed by a written amendment three (3) times for a period of three (3) months each, provided however, that Contractor is in full compliance with all terms and conditions of this Agreement. The purpose of the Agreement is for the Contractor: • To provide nursing care services (“Services”) to individuals experiencing homelessness who are COVID-19 positive or symptomatic at the County temporary housing facility (“Facility”). • The Facility is located at 600 West Van Buren Street, Phoenix, Arizona 85003. The County shall provide the Contractor with $955,584 for services delivery. Also request authorization for the Human Services Department Director to may make changes within the general scope or location of this Agreement on behalf of the County through Administrative Change Orders approved and fully executed by the Parties. Administrative Change Orders may modify the timeline of the activities or location if the last day of the timeline is within the Agreement Term. Funding for this Agreement is provided by Coronavirus Aid, Relief, and Economic Security Act (CARES Act) funds. Services provided by the Contractor shall help to ensure homeless individuals receive the care required as a result of COVID-19 impacts. Supervisory District: All (C-22-20-059-3-00)

AMENDMENT TO THE COMPETITION IMPRACTICABLE CONTRACT WITH CIRCLE THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS Approve Amendment No. 1 to the Competition Impracticable Contract (“Agreement”) between Circle the City (“Contractor”) and Maricopa County administered by its Hu man Services Department (“County”). The purpose of the Amendment is to address the following: A. Extend the Agreement Termination Date from September 30, 2020 to December 30, 2020. B. To clarify the Purpose of the Agreement. C. To clarify Contractor Respon sibilities section of the Agreement. D. Revise Funding, Invoicing, and Payment section by adding final invoice due date and adding Catalog of Federal Domestic Assistance (CFDA) 21.019 Coronavirus Aid, Relief, and Economic Security Act (CARES Act), Public L aw 116-136 as the funding source for the Agreement. E. Revise Exhibit A to include the additional service tiers. The County entered into the Agreement with the Contractor on May 11, 2020 and can be renewed by a written amendment three (3) times for a period of three (3) months each. The Contractor provides nursing and medical care services to individuals experiencing homelessness who are COVID-19 positive or symptomatic at County temporary housing facilities. The foregoing paragraphs contain all the c hanges made by this Amendment No. 1. All other terms and conditions of the Agreement shall remain the same and in full force and effect as approved. 41. AMENDMENT TO THE COMPETITION IMPRACTICABLE CONTRACT WITH CIRCLE THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS Approve Amendment No. 6 to the Competition Impracticable Contract (“Agreement”) between Circle the City (“Contractor”) and Maricopa County administered by its Human Services Department (“County”). The purpose of the Amendment is to address the following: A. Extend the Termination Date from September 30, 2021, through December 31, 2021. B. Revise Section 2.0 (Purpose), by adding Subsections 2.3, to read as follows: 2.3 The Contractor shall provide peer ambassador services to individuals experiencing homelessness. (Peer Ambassadors are current or former clients/patients of Circle the City who have been vaccinated and will utilized their positive experience to encourage other people experiencing homelessness to obtain a Covid-19 vaccination.) C. Revise Section 10.0 (Funding, Invoicing, and Payment), Subsections 10.6, 10.7 and 10.8, to read as follows: 10.6 The County shall provide the Contractor with: i . $600,000 in additional funding to continue medical care and nursing care services to individuals experiencing homelessness who are either COVID-19 positive or symptomatic (or both) at the Phoenix Inn facility, provided under American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds (CSLFRF) under the CFDA number of 21.027. The funding availability period is extended through December 31, 2021. ii. $30,000 in additional funding to hire a Health Unit Coordinator to support staff providing medical care and nursing care services to homeless individuals at the Covid Isolation hotel. The funding for this position shall be provided under American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds (CSLFRF) under the CFDA number of 21.027. The funding availability period is from September 1, 2021 through December 31, 2021. iii. $16,500 in funding to offer peer ambassadors reimbursement for time spent providing services to individuals experiencing homelessness. The funding for services shall be provided by Maricopa County Public Health Department of Epidemiology and Laboratory Capacity (ELC2) CFDA number 93.323. The funding availability period is from October 1, 2021 through December 31, 2021. 10.7 The Agreement amount shall now be increased to a total not-to-exceed amount of $4,840,804. 10.8 The Contractor shall submit monthly invoices no later than the 15th calendar day of each month. 10.9 The Contractor shall submit the September 2021 invoice no later than October 15, 2021. The December 2021 invoice shall be submitted no later than January 15, 2022. D. Revise Section 7.0 (Administrative Change Orders), to address the Administrative Change Orders process. E. Revise Section 28.0 (Contractor Employee Whistleblower Rights and Requirements to Inform Employees of Whistleblower Rights), to address the process for Whistleblower Rights. F. Add the following new sections: 40.0 FORCE MAJEURE 41.0 LOBBYING The foregoing paragraphs contain all the changes made by this Amendment No. 6. All other terms and conditions of the Agreement and previously approved Amendments not amended by this Amendment No. 6 shall remain unchanged and in full force and effect as executed by the Parties. 47. AMENDMENT TO THE COMPETITION IMPRACTICABLE CONTRACT WITH CIRCLE THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS Approve Amendment No. 7 to the Competition Impracticable Contract (“Agreement”) between Circle the City (“Contractor”) and Maricopa County administered by its Human Services Department (“County”). The purpose of the Amendment is to address the following: 1. Extend the Termination Date, retroactively from December 31, 2021 through June 30, 2022. 2. Revise Section 2.0 (Purpose), by addressing the following: 2.1 Continue to provide medical care and nursing care services (“Services”) to individuals experiencing homelessness who are either COVID-19 positive or symptomatic (or both). Contractor shall provide Services at the following locations: 2.1.1 Travelodge Phoenix Downtown located at 600 W. Van Buren Street, Phoenix, 85003 through December 21, 2021; and 2.1.2 Extend A Suites Hotel owned by North Black Canyon Hospitality, LLC (“Hotel”) located at 8101 North Black Canyon Hwy Phoenix, 85021 from December 20, 2021 through June 30, 2022. 3. Revise Section 10.0 (Funding, Invoicing, and Payment) to address the following: 10.6 The County shall provide the Contractor with additional funding in the amount not to exceed $1,367,000 to continue providing Services at the locations listed in Subparagraph 2.1. The funding availability period is from January 1, 2022 through June 30, 2022. Funding is provided under CFDA number 21.027 American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds (CSLFRF). 10.7 The Agreement amount shall now be increased to a total amount of $6,207,804. 10.8 The Contractor shall submit monthly invoices no later than the 15th calendar day of each month. 10.9 The Contractor shall submit the December 2021 invoice no later than January 15, 2022. 10.10 The June 2022 invoice shall be submitted no later than July 15, 2022. All other terms and conditions of the Agreement and previously approved Amendments not amended by this Amendment No. 7 shall remain unchanged and in full force and effect as executed by the Parties. 48. AMENDMENT TO THE COMPETITION IMPRACTICABLE CONTRACT WITH CIRCLE THE CITY FOR SERVICES TO HOMELESS INDIVIDUALS Approve Amendment No. 8 to the Competition Impracticable Contract (“Agreement”) between Circle the City (“Contractor”) and Maricopa County administered by its Human Services Department (“County”). The purpose of the Amendment is to address the following: 1. Revise Section 2.0 (Purpose), by deleting it in its entirety and replace with the following: 2.1 To continue to provide medical care and nursing care services (“Services”) to individuals experiencing homelessness who are either COVID-19 positive or symptomatic (or both). Contractor shall provide Services at the following location: 2.1.1 Extend A Suites Hotel owned by North Black Canyon Hospitality, LLC (“Hotel”) located at 8101 North Black Canyon Hwy Phoenix, 85021 from December 20, 2021 through June 30, 2022. 2.2 The Contractor shall hire an onsite Nurse Supervisor to supervise nursing services to individuals experiencing homelessness at the Covid Isolation hotel identified in 2.1.1 above, through June 30, 2022. 2. Revise Section 10.0 (Funding, Invoicing, and Payment) to address the following: 10.6 The County shall provide the Contractor with additional funding in the amount not to exceed $48,960, representing 50% of the hourly rate for an on-site nurse supervisor listed in Subparagraph 2.2. The funding availability period is from January 1, 2022 through June 30, 2022. Funding is provided under CFDA number 21.027 American Rescue Plan Act, Coronavirus State and Local Fiscal Recovery Funds (CSLFRF). 10.7 The Agreement amount shall now be increased to a total amount of $6,256,764. 10.8 The Contractor shall submit monthly invoices no later than the 15th calendar day of each month. 10.9 The Contractor shall submit the December 2021 invoice no later than January 15, 2022. 10.10 The June 2022 invoice shall be submitted no later than July 15, 2022. All other terms and conditions of the Agreement and previously approved Amendments not amended by this Amendment No. 8 shall remain unchanged and in full force and effect as executed by the Parties.
