34. IGA WITH THE TOWN OF GILBERT Approve a financial Intergovernmental Agreement (Agreement) between the Town of Gilbert (Town), a member of the Maricopa HOME Consortium, and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the County to provide the Town with HOME Investment Partnerships Program funds in the amount not to exceed $274,650 for the Town to acquire and rehabilitate one (1) home and rent to a low-income family. The Agreement term begins on October 21, 2020 and will expire September 30, 2024. Also request authorization for the Human Services Department Director to approve and execute Administrative Change Orders and Addenda as identified in Section 2 (Special Provisions), Paragraph 19.0 (General Conditions). Administrative Change Orders and Addenda – The Human Services Department Director may a.) make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders, and b.) identify the single-family properties that are subject of Paragraph 1.0 (Scope of Work) of Section 3 (Work Statement) of this Agreement through Addenda. Both Administrative Change Orders and Addenda shall be approved and fully executed by the Human Services Department Director and the Town. This Agreement is funded by grants from the U. S. Department of Housing and Urban Development (HUD). Funding is included in the FY2021 budget and does not impact the General Fund. 41. AMENDMENT TO IGA WITH THE TOWN OF GILBERT Approve Amendment No. 1 to the Intergovernmental Agreement (Agreement) between the Town of Gilbert (Town), a member of the Maricopa HOME Consortium, and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the County to provide the Town with HOME Investment Partnerships Program funds to acquire and rehabilitate one (1) home and rent to a low-income family in the Town of Gilbert. The Subrecipient and the County shall be referred to as the “Parties.” The purpose of the Amendment is to address the following items: A. Extend the Agreement termination date from September 30, 2024 through September 30, 2025. B. Add an additional Work Statement hereinafter referred to as “2021 Work Statement,” attached and incorporated into the Agreement. The 2021 Work Statement is for the Town to purchase and rehabilitate a single-family, affordable rental home. C. The County shall provide $280,368 for the Work Statement activities. The Agreement funding amount shall be increased from $274,650 to $555,018. D. Funding for this Amendment No. 1 is provided by HOME Investment Partnerships Program (HOME) and U.S. Department of Housing and Urban Development (HUD) funds, CFDA No. 14.239. E. Revise Section 1 (General Provisions) to address the following paragraphs: 1. Revise Paragraph 51.0 (CONTRACTOR EMPLOYEE WHISTLEBLOWER RIGHTS AND REQUIREMENT TO INFORM EMPLOYEES OF WHISTLEBLOWER RIGHTS) to address the Whistleblower Rights process. 2. Add Paragraph: 54.0 FORCE MAJEURE F. Revise Section 2 (Special Provisions) to address the following paragraph: 1. Revise Subparagraph 19.1 (ADMINISTRATIVE CHANGE ORDERS) to address the Administrative Change Order process. G. Revise Section 4 (Compensation) to address the following paragraph: 1. Revise Paragraph 3.0 (TIMELINESS) to address the Timeliness process. The Agreement is amended to incorporate the changes contained in this Amendment No. 1. All other terms and conditions of the Agreement shall remain unchanged and in full force and effect as executed by the Parties. AMENDMENT TO IGA WITH THE TOWN OF GILBERT Approve financial Amendment No. 2 to the Intergovernmental Agreement (Agreement) between the Town of Gilbert (Town), and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the Town to acquire and rehabilitate homes and rent to low-income families in the Town of Gilbert. The County shall provide the Town with HOME investment partnerships funds. The purpose of the Amendment is to address the following items: A. Change Lead Agency Point of Contact. B. Revise Section 3 (Work Statement), to address the following paragraphs: 1. Add 2022 Work Statement: The Town shall purchase and rehabilitate a home and rent to eligible low-income family in the Town. If the Town has completed the required Environmental Review, expenditures may be retroactive to July 1, 2022. The County shall provide the Town with $318,134 for the Work Statement activities, funding is provided by PY22 HOME Investment Partnerships Program (HOME) through the U.S. Department of Housing and Urban Development (HUD) funds, under (ALN) 14.239. All work performed, or costs incurred expenses shall be reimbursable through September 30, 2025. 2. Add 2021 HOME–ARP Work Statement: The Town shall purchase and rehabilitate a minimum of two homes in the Town and rent to eligible low-income families. If the Town has completed the required Environmental Review, expenditures may be retroactive to July 1, 2022. The County shall provide the Town with $1,174,917 for the Work Statement activities. The funding for this Work Statement is provided by HOME-ARP through the U.S. Department of Housing and Urban Development (HUD) funds, under ALN 14.239. All work performed, or costs incurred expenses shall be reimbursable through September 30, 2025. C. The Agreement funding amount shall be increased from $555,018 to $873,152 in HOME funds and $1,174,917 HOME-ARP funds. The Agreement is amended to incorporate the changes contained in this Amendment No. 2. All other terms and conditions of the Agreement shall remain unchanged and in full force and effect as executed by the Parties. The County shall provide the Town with HOME investment partnerships funds. The purpose of the Amendment is to address the following items: A. Revise Section 1 (General Provisions) 36.0 INSURANCE, delete in its entirety and replace with the following: 36.0 INSURANCE The Subrecipient shall provide the County a Certificate of Self-Insurance equal to: General Aggregate $3,000,000 Each Occurrence Limit $1,000,000 B. Revise Section 1 (General Provisions) to add the following paragraph: 55.0 UYGHUR FORCED LABOR PREVENTION ACT (UFLPA) C. Revise Section 3 (Work Statement) to address the following paragraph: 1. Add an additional Work Statement hereinafter referred to as “2023 Work Statement”. The Work Statement is for the Town to purchase and rehabilitate a single-family home made available for rental to an eligible family. The County shall provide the Town with $337,297 for this activity. The funding is provided by PY23 HOME HUD funds, under ALN 14.239. All work performed or costs incurred or expensed shall be reimbursable through September 30, 2025. D. The Agreement funding is increased by $337,297 from $2,048,069 to a new total amount of $2,385,366 and will consist of the following fund sources: The Agreement is amended to incorporate the changes contained in this Amendment No. 3. All other terms and conditions of the Agreement and previously approved Amendments shall remain unchanged and in full force and effect as executed by the Parties. AMENDMENT TO IGA WITH TOWN OF GILBERT FOR HOME INVESTMENT PARTNERSHIPS ACTIVITIES Approve financial Amendment No. 4 to the Intergovernmental Agreement between the Town of Gilbert (Town), and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the Town to conduct HOME Investment Partnerships Program (HOME) activities. The Town shall acquire and rehabilitate homes and rent to low-income families in the Town of Gilbert. The County provides the Town with U.S. Department of Housing and Urban Development (HUD) HOME funds. The purpose of the Amendment is to address the following items: A. Extend the Agreement termination date from September 30, 2025, through September 30, 2026. B. Update County’s Point of Contact C. Add required clauses to the Agreement D. Revise Administrative Change Order clause that authorizes the Chairman to review and execute Administrative Change Orders. E. Add 2024 Work Statement which addresses the following: 1. The Town shall purchase and rehabilitate a single-family home, made available to rent to an eligible family. 2. The County shall provide the Town with $305,491 for this activity. The funding for Amendment No. 4 is provided by PY24 HOME HUD funds, under ALN 14.239. 3. All work performed or costs incurred or expensed shall be reimbursable through September 30, 2025. F. The total Agreement funding amount is increased by $305,491 for a new Agreement total of $2,690,857. The Agreement is amended to incorporate the changes contained in this Amendment No. 4. All other terms and conditions of the Agreement and previously approved Amendments shall remain unchanged and in full force and effect as executed by the Parties.
