67. IGA WITH CITY OF EL MIRAGE Approve an intergovernmental Agreement (“Agreement”) between City of El Mirage (the “Subrecipient”) and Maricopa County Human Services Department, (“County”). The Agreement's purpose is for the Subrecipient to construction a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. The COVID-19 pandemic required socially distancing measures to be implemented to prevent the spread of the COVID-19 virus. The path has been an unofficial/undefined way for children to walk to school, employees to walk/bike to work, and residents to exercise. The current 4-feet wide path is not wide enough to prevent the spread of airborne viruses. The new multi-use trail will be a defined space and will include lighting which will encourage more residents to be active and provide safe connectivity to community amenities. Beneficiaries of this project will be City of El Mirage residents. The County will provide the Subrecipient with U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds in the amount not-to-exceed $500,000. Agreement term shall begin December 1, 2021 and will expire March 31, 2023. Per Section 2 (Special Provisions), Paragraph 13.0 (Additional Certifications and Warranties), Subparagraph 13.1.18, also request authorization for the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the Subrecipient. Change Orders/Administrative Changes will receive legal review and will be filed with the Clerk of the Board’s office upon full execution. FY2022: $500,000 Supervisory Districts 4 (C-22-22-052-X-00)

53. AMENDMENT TO IGA WITH CITY OF EL MIRAGE FOR CDBG ACTIVITIES Approve Amendment No. 1 to the Intergovernmental Agreement (“Agreement”) between City of El Mirage (the “Subrecipient”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the Subrecipient to construction a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetw ater Road. The Subrecipient and the County shall be referred to as the “Parties.” The purpose of the Amendment is to address the following items: A. The County shall provide the Subrecipient with an additional $450,000 to complete construction of a twelv e (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. B. The Agreement amount shall now be increased to a total not-to-exceed amount of $950,000. Funding for Amendment No. 1 is provided by Assistance Listing Number (ALN) 14.218, U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds. C. Revise Section 2 (Special Provisions) Paragraph 7.0 (Administrati ve Requirements) to address the Unique Entity Identifier (UEI) and federal System for Award Management (SAM) process. D. Revise Section 3 (Work Statement) Paragraph 2.0 (Scope of Work) to add the following subparagraph: 2.6 IMPLEMENTATION SCHEDULE E. 26. AMENDMENT TO IGA WITH CITY OF EL MIRAGE Approve Amendment No. 2 to the Intergovernmental Agreement (“Agreement”) between City of El Mirage (the “Subrecipient”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the Subrecipient to construction a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. The Subrecipient and the County shall be referred to as the “Parties.” The purpose of the Amendment No. 2 is to address the following items: 1. Add Point of Contact for Maricopa County. 2. Extend the Agreement term from March 31, 2023, through June 30, 2023. 3. The County shall provide the Subrecipient with an additional $250,000 to complete construction of a twelve (12) foot wide multi-use trail connecting West Cactus Road, west of North El Mirage Road to North Dysart Road, north of West Sweetwater Road. Funding is provided under the (ALN) 14.218, U.S. Department of Housing and Urban Development (HUD) Community Development Block Grant CARES Act (CDBG-CV) funds. 4. The Agreement amount shall now be increased to a total not-to-exceed amount of $1,200,000. 5. Revise Section 3 (Work Statement) Paragraph 2.0 (Scope of Work) to revise 2.6 Implementation Schedule 6. Revise Section 4 (Budget and Compensation) Paragraph 1.0 (Budget) to reflect new Agreement amount. The Agreement is amended to incorporate the changes contained in this Amendment No. 2. All other terms and conditions of the Agreement and previously approved Amendment shall remain unchanged and in full force and effect as executed by the Parties.
