54. IGA WITH THE CITY OF SCOTTSDALE FOR HOME FUNDED ACTIVITIES Approve a financial Intergovernmental Agreement (“Agreement”) between the City of Scottsdale and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to acquire and rehabilitate two (2) single-family houses in Scottsdale. The two homes will provide affordable rental housing opportunities for HOME income eligible residents. One single-family home will be funded with Program Year 2020 funds and one single-family home will be funded with Program Year 2021 funds. The County will provide the City with U. S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program (HOME)) funds, CFDA 14.239 for Program Year 2020 and Program Year 2021 activities. For Program Year 2020 in the amount not-to-exceed $342,917 and for Program Year 2021 in the amount not-to-exceed $344,125. The County shall provide the City with a total of $687,042 for HOME funded activities. The Agreement term shall begin March 23, 2022 and will expire September 30, 2024. Per Section 2 (Special Provisions), Paragraph 21.0 (General Conditions), Subparagraph 21.1 (Administrative Change Orders) request authorization for the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the CHDO. Change Orders/Administrative Changes will receive legal review and will be filed with the Clerk of the Board’s office upon full execution. 35. AMENDMENT TO IGA AGREEMENT WITH THE CITY OF SCOTTSDALE FOR HOME FUNDED ACTIVITIES Approve financial Amendment No. 1 to the Intergovernmental Agreement between the City of Scottsdale and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to acquire and rehabilitate two (2) single-family houses in Scottsdale. One single-family home will be funded with Program Year 2020 funds and one single-family home will be funded with Program Year 2021 funds. Extend the term of the Agreement from September 30, 2024 through September 30, 2025. C. Add paragraph: 54.0 UYGHUR FORCED LABOR PREVENTION ACT (UFLPA) D. Revise Section 3 (Work Statement) to add two new Work Statements for HOME funded activities for the Subrecipient to complete: 1. 2022 Work Statement. The City shall administer the Tenant Based Rental Assistance (TBRA) Program to help prevent homelessness by providing decent and affordable rental housing for families in need. The County shall provide the City with $366,675 Program Year 2022 HOME funds. All work performed, or costs incurred expenses shall be reimbursable through September 30, 2025. 2. 2021 HOME-ARP Work Statement. The City shall acquire and develop multi-family housing to help prevent homelessness by providing decent and affordable rental housing for individuals and families in need. The County shall provide the City with HOME ARP funding in a not to exceed amount of $1,442,098 Program Year 2021. All work performed, or costs incurred expenses shall be reimbursable through September 30, 2025. E. The Agreement funding amount shall be increased by $1,808,773 from $687,042 to $2,495,815 and shall consist of the following fund sources: • $1,442,098 – HOME ARP • $366,675 – HOME funds The Agreement is amended to incorporate the changes contained in Amendment No. 1. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. 88. AMENDMENT TO IGA WITH CITY OF SCOTTSDALE FOR HOME FUNDED ACTIVITIES Approve financial Amendment No. 2 to the Intergovernmental Agreement between the City of Scottsdale and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the City to acquire and rehabilitate single-family homes to provide affordable rental housing opportunities to income eligible residents in the City of Scottsdale. The County provided the City with U.S. Department of Housing and Urban Development (HUD) HOME funds. The purpose of the Amendment is to address the following: A. Extend the term of the Agreement from September 30, 2025, through September 30, 2026. B. Update Points of Contact. C. Update Agreement required language. D. Replace Administrative Change Order language. E. Extend expenditure period timeframes for Work Statements. F. Add PY2023 Work Statement to the Agreement which addresses the following: 1. The City will administer the Tenant Based Rental Assistance (TBRA) Program to help prevent homelessness by providing rental assistance to families. 2. The County shall provide the City with PY23 HOME funding in an amount of $355,614 for the Work Statement activities. Funding for this Work Statement is provided by the U.S. Department of Housing and Urban Development (HUD), under ALN 14.239. 3. All work performed, or costs incurred or expended shall be reimbursable through September 30, 2026. The expenditures period of availability for reimbursement shall be retroactive to July 1, 2024. G. The total Agreement funding is increased by $355,614 for a new Agreement total of $2,851,429. The Agreement is amended to incorporate the changes contained in Amendment No. 2. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. 58. AMENDMENT TO THE IGA WITH CITY OF SCOTTSDALE FOR HOME FUNDED ACTIVITIES Approve financial Amendment No. 3 to the Intergovernmental Agreement between the City of Scottsdale (City) and Maricopa County (County) administered by its Human Services Department. The purpose of the Agreement is for the City to acquire and rehabilitate single-family homes to provide affordable rental housing opportunities to income eligible residents in the City of Scottsdale. The County has provided the City with U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnership funds (HOME) in the amount of $2,851,429 under Assistance Listing Number (ALN) 14.239. The term of the Agreement is March 30, 2022, through September 30, 2026. The purpose of the Amendment is to address the following: A. Revise the Contract Amount on Page 1 to reflect a new Agreement funding total of $3,138,728. B. Extend the term of the Agreement from September 30, 2026, through September 30, 2028. C. Revise Section 1 (General Provisions), Paragraph 49.0 (Certification Regarding Debarment, Suspension, Ineligibility And Voluntary Exclusion), Subparagraph 49.1.3 and replace in its entirety. D. In Section 2 (Special Provisions) revise and replace: 1. Paragraph 19.0 (Program Completion), Subparagraph 19.2. 2. Paragraph 20.0 (Failure To Make Progress), Subparagraph 20.1.1. 3. Paragraph 23.0 (Violence Against Women Reauthorization Act of 2013). E. In Section 3 (Work Statement) revise and replace: 1. Revise PY 2020 and 2021 Work Statement- Home Rental to extend the expenditure deadline to September 30, 2026. $686,829.68 in HOME funds will be used for the purchase and rehabilitation of two (2) single-family homes for the purpose of providing affordable rental housing in Scottsdale. 2. Add a new PY 2021 Work Statement-HOME TBRA with an expenditure deadline of September 30, 2026. $212.32 in HOME funds will be used for this activity. 3. Replace PY 2021 HOME-ARP Bridging Housing Stability Work Statement with two Work Statements: A new PY 2021 HOME-ARP TBRA Program Work Statement in the amount of $725,171 with an expenditure deadline of September 30, 2028, in HOME ARP funds for TBRA activities; a new PY 2021 HOME-ARP Supportive Services Program Work Statement in the amount of $716,927, in HOME-ARP funds to administer HOME-ARP program activities and provide homelessness prevention supportive services to qualifying individuals and families with an expenditure deadline of September 30, 2028. 4. Add a new PY 2024 Work Statement-HOME TBRA with an expenditure deadline of September 30, 2028. $287,299 in HOME funds will be used for this activity. The Agreement is amended to incorporate the changes contained in Amendment No. 3.
