AMENDMENT TO COMPETITION IMPRACTICABLE AGREEMENT WITH HOM INCORPORATED Approve Amendment No. 2 to the financial Competition Impracticable Agreement between HOM Incorporated (Contractor) and Maricopa County administered by its Human Services Department. The purpose of the Agreement is for the Contractor to administer a centralized, systemwide, landlord engagement service for homeless services system in Maricopa County. The County provided the Contractor with $4,970,555 in American Rescue Plan Act (ARPA) funds under ALN 21.027 for Agreement activities. The agreement term is July 14, 2021, through June 30, 2025 The Purpose of the Amendment is to address the following: Revise the Budget- The Contractor shall reallocate $677,500 from Total Direct Salaries and Administration to Total Landlord Financial Incentive and Risk Mitigation Funding line items. The overall Agreement budget remains unchanged. All other terms and conditions of the Agreement and approved Amendment No. 1 remain in full force and effect. This Amendment No. 2 shall be effective upon approval and signature by both Parties. This Amendment will not impact the County General Fund. Supervisor District: All (C-22-22-151-X-02)

52. AMENDMENT TO AGREEMENT WITH HOM, INC. FOR A CENTRALIZED, SYSTEMWIDE LANDLORD ENGAGEMENT SERVICE Approve financial Amendment No. 1 to the Agreement between HOM, Inc. (“Contractor”) and Maricopa County (the “County”) administered by its Human Services Department. The purpose of the Agreement is for the Contractor to provide a centralized, systemwide landlord engagement service for the homeless population in Maricopa County. The purpose of the Amendment No. 1 is to address the following: A. Extend the Contract term from June 30, 2023, through June 30, 2025. B. Increase funding amount by $2,500,000 from $4,970,556 to a not to exceed amount of $7,470,556. C. Revise Section 1.0 (General Provisions) by adding the following paragraphs: 52.0 UYGHUR FORCED LABOR PREVENTION ACT (UFLPA) 53.0 FORCE MAJEURE D. Revise Section 2 (Special Provisions) in the following subparagraphs (Documentation and Recording Keeping) and (Subcontracts) by removing in its entirely and replacing with revised contract language. E. Revise Section 3.0 (Work Statement) subparagraph 3.0 (Performance Management Deliverables), sub-subparagraph 3.7 by removing in its entirely and replacing with revised contract language. F. Revise Section 4 (Budget and Compensation) by addressing the following: 1.0 Remove the Budget in its entirety and replace with a revised budget. The Agreement is amended to incorporate the changes contained in Amendment No. 1. All other terms and conditions of the Agreement shall remain the same and unchanged and in full force and effect as executed by the Parties. Extend the Agreement term through December 31, 2026. C. The County shall increase the funding amount by $600,000 in County General Funds for a new Agreement total funding amount of $8,100,000. D. The County provided the Contractor with $7,500,000 in American Rescue Plan Act (ARPA) State and Local Fiscal Recovery Funds (SLFRF) under Assistance Listing Number 21.027, provided to the County by the US Department of Treasury, and $700,000 in County General funds were provided, for an Agreement total funding amount of $8,200,000. The current term of the Agreement is July 14, 2021, through December 31, 2026. The purpose of Amendment No. 6 is to address the following: A. Extend the Agreement expiration date through June 30, 2027 B. The County shall increase the Agreement funding by adding $800,000 in Fiscal Year 2027 County allocated General Funds, funds to be fully expended by 6/30/2027 C. The Agreement funding shall hereby increase from $8,200,000 to a new total agreement amount of $9,000,000 D. Amend the Scope of Work in Section 3.0 (Work Statement) by revising and replacing it with an updated Scope of Work which incorporates the Eviction Diversion Program into the Agreement’s Scope of Work E. Revise Section 4.0 (Budget and Compensation) Paragraph 1.0 BUDGET, by adding paragraph 1.1 Eviction Diversion Budget, Budget to be incorporated into the Agreement by Addendum. All other terms and conditions of the Agreement and previously approved amendments remain in full force and effect as executed by the Parties.
