86. AGREEMENT WITH ROERS BUCKEYE DOWNTOWN LIMITED PARTNERSHIP Approve the following actions: A financial Contract (“Contract”) between Maricopa County, administered by its Human Services Department (“County”), and Roers Buckeye Downtown Limited Partnership, Minnesota limited Partnership (“Contractor” or “Developer”). The County and the Contractor are collectively referred to here as the “Parties” and individually as a “Party.” The purpose of the Contract is for the Contractor to construct Solana Villas Apartments, a 200-unit affordable rental housing community. Rental opportunities for these apartments will be available for eligible low- and moderate-income residents in Buckeye, Arizona. The County will provide the Contractor with Assistance Listing Number (ALN) 21.027, American Rescue Plan Act – Coronavirus State and Local Fiscal Recovery Funds in the amount not-to-exceed $2,000,000. Contract term shall begin September 14, 2022 and will expire September 30, 2024. Authorize the Chairman to sign and execute the following: Change Orders/Administrative Changes as listed in Paragraph 7.9 ADMINISTRATIVE CHANGE ORDERS, authorizing the Chairman of the Board of Supervisors to approve and execute upon the recommendation of the Human Services Department Director and Legal Counsel to make changes within the general scope of the Contract on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representative for the Contractor. Change Orders/Administrative Changes will receive legal review and will be filed with the Clerk of the Board’s office upon full execution. Authorize the Chairman to sign any of the following documents that pertain to the Contract: Promissory Notes. Deed of Trusts. Declarations and other documents.
