33. AGREEMENT WITH NEWTOWN COMMUNITY DEVELOPMENT CORPORATION AND CITY OF AVONDALE Approve a financial Agreement (“Agreement”) between Newtown Community Development Corporation, a Community Housing Development Organization (“CHDO”), the City of Avondale (“Administrator”) and Maricopa County (“County”) administered by its Human Services Department. The CHDO, the Administrator, and the County are collectively referred to in this Agreement as the “Parties” and individually as a “Party.” The purpose of the Agreement is for Newtown Community Development Corporation, as the designated CHDO, to acquire land from the City of Avondale and construct three affordable (3) single-family homes to be made available to the residents of Maricopa County. The Legacy Avondale Infill Housing Redevelopment Project-Phase 3 is in a Qualified Census Track located at 305 and 309 East Hill Drive, Avondale, Arizona 85323. The land will be re-platted and sold by the Administrator to the CHDO at closing. The new homes to be constructed will be included in Newtown’s Community Land Trust Program (CLT) program and remain affordable per 24 CFR 92. The County shall provide the CHDO and the Administrator with PY23/FY24 funds through the U.S. Department of Housing and Urban Development (HUD) HOME Investment Partnerships Program funds in the amount of $796,326. The Agreement term shall begin March 27, 2024, and will expire December 31, 2026. The County shall provide the CHDO with an agreement amount of $796,326. Per Section 1 (General Provisions), Paragraph 6.0 (Administrative Change Orders), also request authorization for the Chairman of the Board of Supervisors to approve and execute, upon the recommendation of the Human Services Department Director and Legal Counsel, changes within the general scope of the Agreement on behalf of the County through Administrative Change Orders. Administrative Change Orders shall be approved and fully executed by the Chairman of the Board of Supervisors and the authorized representatives for the CHDO and the Administrator. Change Orders/Administrative Changes will receive legal review and will be filed with the Clerk of the Board’s office upon full execution. Supervisory District: 5 (C-22-24-095-X-00)
