25. BUSINESS ASSOCIATE AGREEMENT WITH COMPUMED Approve the Business Associate Agreement with CompuMed and Maricopa County by and through its Department of Correctional Health Services (MCDCHS). This is a non-financial agreement between the parties. The term of this Agreement shall become effective upon the last signature and shall continue to be in effect until terminated by either party. The purpose of this Agreement is to comply with the requirements of the Health Insurance Portability and Accountability Act of 1996 (42 USC §1320d et seq.) (“HIPAA”), the Health Information Technology for Economic and Clinical Health Act (“HITECH”) of the American Recovery and Reinvestment Act of 2009 (ARRA), which made changes to various provisions of HIPAA, including updating the definition of a business associate and imposing additional obligations and responsibilities on business associates by implementing privacy and security regulations set forth at 45 CFR Parts 160 and 164 (the “HIPAA Rules”) and any applicable state confidentiality laws.
