21. JUVENILE PROBATION GRANTS FOR FY 2009-10 Approve the application for and acceptance of the FY 2009-10 grants for the Juvenile Probation Department of the Judicial Branch in the amount of $5,466,022. Approval of the grants agenda will increase grant funding by $423,499 because actual grant funding received was greater than anticipated and budgeted. Therefore, per A.R.S. § 42-17106(B), approve increases to the FY 2009-10 Juvenile Probation (270) Juvenile Probation Grants Fund (227) Operating (0000) revenue and expenditure appropriations of $423,499. Grant revenues are not local revenues for the purpose of constitutional expenditure limitation, and therefore, expenditure of these revenues is not prohibited by the budget law. This budget adjustment does not alter the budget constraining the expenditures of local revenues duly adopted by the Board pursuant to A.R.S. § 42-17105. The indirect cost rate as of July 1, 2009 is 24.8%, as calculated by the Department of Finance. Most of the grants for FY 2009-10 do not allow for indirect cost recovery, as reflected in the funding agreements. The status of the indirect costs for each grant is noted on the attached summary sheet. Administrative Order #95-50, approved by Presiding Judge Robert D. Myers on June 29, 1995, adopted for the Judicial Branch a policy for the administration of grant funding. The policy, identical in form and substance to the policy adopted by the Board of Supervisors for all County Departments, states that the Presiding Judge will make a presentation of the Judicial Branch's grants to the Board of Supervisors on an annual basis. A summary of each grant has been prepared in accordance with the provision of the policy. The total amount of Juvenile Probation Grants Fund (227) grant revenue to be received is $14,507,728 (includes "Retained by Grantor"); the total indirect cost to be recovered is $36,707; and the unrecoverable indirect cost is $1,080,856. The Juvenile Probation Grants Fund (227) current revenue and expenditure appropriation is $5,042,523. (C-27-10-003-2-00)
