57. AMENDMENT TO SPECIAL USE AGREEMENT WITH ARIZONA KARTING ASSOCIATION Approve Amendment Four to the Special Use Agreement between Maricopa County and Arizona Karting Association (C-30-02-047-B) extending the term date from April 5, 2012 to March 3, 2018 which also results in an amendment to the Concessionaire’s Administrative Fee Schedule. The original terms of the Agreement were April 6, 2002 through April 5, 2007 with two (2) 5-year renewal options. Amendment One (C-30-02-047-B-01), dated July 2, 2003, revised the legal description. Amendment Two (C-30-02-047-B-02), dated June 21, 2006, clarified the language of the Agreement and exercised the first of the two (2) 5-year renewal options (April 6, 2007 through April 5, 2012). Amendment Three (C-30-02-047-B-03), dated December 5, 2007, exercised the last 5-year renewal option (April 6, 2012 through April 5, 2017) and agreed to a new Administrative Fee Schedule with no renewal options remaining. This Amendment Four will extend the agreement an additional term commencing upon the expiration of the original term (April 5, 2017) and shall now expire on March 3, 2018 to include an amended fee schedule. 38. AMENDMENT TO ARIZONA KART ASSOCIATION’S SPECIAL USE AGREEMENT Approve Amendment Five to the Special Use Agreement between Maricopa County and Arizona Karting Association (C-30-02-047-B) extending the term date from March 4, 2018 to March 3, 2019 which also results in an amendment to the Concessionaire’s Administrative Fee Schedule. Both Arizona Karting Association, a dirt-track go-kart racing facility and the Phoenix Kart Racing Association, an asphalt go-kart racing facility terms expire March 3, 2019 with no renewal options. These two facilities are located next to each other at Adobe Dam Regional Park. It is expected that when the agreements terminate it will be in the County’s best interest to advertise a combination of both facilities into one Invitation to Negotiate (ITN). An extension to the term is necessary to allow enough time to issue the ITN. The ITN may provide options for one concessionaire to manage both tracks or for one concessionaire to provide a different recreational use for both facilities that fits into the Adobe Dam Regional Park Master Plan and meets the Parks mission and vision.
