AMENDMENT TO USE MANAGEMENT AGREEMENT WITH FORT ADOBE PAINTBALL COMPLEX, LLC Approve Amendment No. 4 to the Use Management Agreement between Maricopa County and Fort Adobe Paintball Complex, LLC (C-30-07-028-1-00) entered into April 18, 2007, in order to insert a legal description for the Concession Site and to amend the Fee Payment Schedule due to delays in permitting and construction not the fault of the Fort Adobe Paintball Complex, LLC. Total term of the Agreement is April 18, 2007 through December 31, 2016 with two five-year renewal options remaining. The effective date of this Amendment Four is the date of Board approval. 79. ADMINISTRATIVE CORRECTION AND AMENDMENT TO USE MANAGEMENT AGREEMENT WITH FORT ADOBE PAINTBALL COMPLEX, LLC Approve Amendment Four to the Use Management Agreement at Adobe Dam Regional Park between Maricopa County and Fort Adobe Paintball Complex, LLC (C-30-07-028-1-00) for the development, operation and maintenance of a paintball complex, entered into April 18, 2007, in order to amend the fee payment schedule due to economic conditions beyond the control of either Party. Total term of the Agreement is April 18, 2007 through December 31, 2016 with two (2) five (5) – year renewal options remaining. The effective date of this Amendment Four is the date of Board approval. There is no financial impact. Also approve an Administrative Correction to the action taken on May 6, 2009 (C-30-09-025-3-00) which authorized the approval of Amendment No. 4 to the Use Management Agreement with Fort Adobe Paintball Complex. This correction will change the amendment number from four (4) to three (3) and re-establish the correct file for this amendment as C-30-07-028-1. This correction does not change the direction or intent of the previous actions. (C-30-07-028-1-04)

75. TERMINATION OF USE MANAGEMENT AGREEMENT WITH FORT ADOBE PAINTBALL COMPLEX, LLC Approve the termination (Termination) of the Use Management Agreement (UMA) entered into between Maricopa County and Fort Adobe Paintball Complex, LLC, for the management, operation and maintenance of the Fort Adobe Paintball Complex located at Adobe Dam Regional Park (C-30-07-028-1-00) dated April 18, 2007, as amended. Termination is mutually requested as the concessionaire has closed his business July 1, 2016 due to financial constraints. As full and final payment of the concession fees in the amount of $25,068.04, the concessionaire along with a recommendations from the Director of Parks and Recreation Department and the Parks Commission Advisory Board, agree that the concessionaire will transfer, and the County, through its Parks and Recreation Department, will accept, ownership of concessionaire’s property described as follows: a 2008 Wells Cargo Comfort Elite ADA +2 Portable Restroom Trailer Vehicle Identification Number 1WC200J1585001334. This item will become an asset to the Parks and Recreation Department. The effective date of the Termination of the UMA shall be July 1, 2016. This item is located in Supervisory District No. 3.
