COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT Approve the Commercial Management Concessions Agreement between Maricopa County and Spur Cross Stables, LLC in order to manage, operate and maintain a commercial concession within the Maricopa County Regional Park System. Term of the Agreement is from the Effective Date, the date approved by the Board of Supervisors, through December 31, 2011 with ten (10 one (1)-year renewal options. 51. AMENDMENT TO COMMERCIAL MANAGEMENT CONCESSIONS AGREEMENT WITH SPUR CROSS STABLES LLC Approve Amendment One to the Commercial Management Concessions Agreement (C-30-11-002-3-00) entered into between Maricopa County and Spur Cross Stables, LLC on August 4, 2010 in order to manage, operate and maintain a commercial concession within the Maricopa County Regional Park System. Amendment One exercises three of the one-year Renewal Options and makes some administrative changes to the Agreement. Term of the Agreement is, upon approval and execution by the Board of Supervisors from August 4, 2010 (“Effective Date”) through December 31, 2014 with seven (7) one (1)-year renewal options remaining. Guaranteed revenue for Maricopa County Parks and Recreation Department (Department 300) (Fund 225) throughout the term of the Agreement is $150. (C-30-11-002-3-01)

36. TERMINATION OF COMMERCIAL MANAGEMENT CONCESSION AGREEMENT WITH SPUR CROSS STABLES, LLC Approve the termination of the Commercial Management Concession Agreement as amended (C-30-11-002-3-02) between Maricopa County Spur Cross Stables, LLC (Concessionaire) on August 4, 2010 (Agreement) and delegate authority to Director of Maricopa County Parks and Recreation Department (MCPRD) or his designee to provide prior written notice to Concessionaire to terminate the Agreement. The Agreement authorized the Concessionaire to manage, operate and maintain a concession within the Maricopa County Regional Park System. Termination will be effective as of September 4, 2019. This termination is due to Maricopa County and Concessionaire entering into a new Commercial Management Concession Agreement (New CMCA), covering the same concession as the Agreement and requiring the Concessionaire to now pay the greater of an annual minimum fee or an annual fee based on 10% of gross revenue, among other things. Pursuant to Resolution C-30-18-016-M-00, the Board has delegated signature authority to the MCPRD Director to enter into the New CMCA with the Concessionaire. All activities for this concession were located at Supervisory District #2. (C-30-11-002-3-03)
