47. IGA WITH TOWN OF CAVE CREEK FOR COOPERATIVE FILING FOR TRANSFERRING TITLE AND ESTABLISHING THE BENEFICIAL USE OF WATER RIGHTS Approve an Intergovernmental Agreement (IGA) between the Town of Cave Creek, and Maricopa County for the purpose of cooperatively filing for the transferring of title and establishing the beneficial use of water rights for Spur Cross Ranch Conservation Area and the Phoenix Mine Site property. Maricopa County and the Town of Cave Creek wish to cooperatively file the documents necessary for transferring title and establishing the beneficial use of the Water Rights for Spur Cross and the Phoenix Mine Site Property which are identified in the attached Exhibit 1 incorporated herein. The County, Town and State of Arizona purchased the Spur Cross Ranch Conservation Area to be managed for open space, recreation and conservation purposes. Subsequent to that acquisition, the proper paperwork was not filed to officially document the transfer of those rights to the current owners (Maricopa County and the Town of Cave Creek). The parties now wish to officially file Statements of Claim of Right to Use Public Waters of the State of Arizona, and Applications to Sever and Transfer with the Arizona Department of Water Resources. This agreement will allow for the claim to be filed and provides guidance for the management of those water rights to benefit the conservation area. This Intergovernmental Agreement is non-financial and is effective from November 4, 2010 until January 8, 2061. (C-30-11-026-3-00)

68. AMENDMENT TO IGA WITH THE TOWN OF CAVE CREEK Approve Amendment No. 1 to an Intergovernmental Agreement (IGA) between Town of Cave Creek, for Cooperative filings necessary for transferring title and establishing the beneficial use of certain water rights related to the Spur Cross Conservation Area and the Phoenix Mine site property, and Maricopa County through the Parks and Recreation Department. The purpose of this amendment is to change the allotment of water to be registered to each party. This amendment is non-financial and is effective from August 3, 2011 until January 8, 2061. All other terms and conditions of the Intergovernmental Agreement remain in full force and effect. The County will have the necessary filing prepared to reflect the transfer of water rights associated with Certificate No. 402 to County and the Town in the following proportion - one thousand two hundred and fifty two acre feet to be registered to the County and five hundred fifty two acre feet to be registered to the Town of Cave Creek. 33. AMENDMENT TO IGA WITH THE TOWN OF CAVE CREEK Approve and authorize Chairman to execute Amendment Two to Intergovernmental Agreement (C-30-11-026-3-00 as amended) (Amendment Two) between Maricopa County (County) and the Town of Cave Creek (Town) (Agreement) to clarify responsibilities for preparing and filing the documents necessary for transferring title and establishing the beneficial use of the water rights in the Spur Cross Ranch Conservation Area (Spur Cross), and authorize the County’s Parks and Recreation Director, or his designee, to take administrative action related to preparing such documents. County and Town acquired Spur Cross in 2001, however, the associated water rights have not yet been recorded at Arizona Department of Water Resources (ADWR). This Amendment Two sets forth the responsibilities and procedures for both the Town and County to prepare the necessary filings related to Spur Cross water rights to be filed with ADWR.
