47. AMENDMENT TO IGA WITH CITY OF CHANDLER Approve Amendment No. 2 to the Intergovernmental Agreement (“Agreement”) (CS-93-1-023) dated January 12, 1993 between Maricopa County and the City of Chandler (“City”) which transferred two hundred twenty five (225) acres of the Amstar Spreckles property (“Site”) for the construction of a golf course which was recorded with Maricopa County Recorder as Instrument No. M.C.R. 93-078303. A Special Warranty Deed restricts use of the Site to a golf course and related facilities. Amendment Two continues the operation, management and maintenance of the golf course known as Bear Creek Golf Course; however, requires a revised Special Warranty Deed to allow a communication tower(s) and related facilities to be constructed at the golf course. The addition of the communication towers(s) will provide an additional revenue source for the City and the County and improve telecommunications within the city limits of Chandler. Guaranteed income to the County (Department 300) (Fund 241) remains unchanged from the Agreement; however, effective January 1, 2012, upon approval of Amendment Two and the City entering into a telecommunication agreement, County will receive a percentage of fees paid to the City. Term of the Agreement is through December 31, 2029 with two (2) ten (10)-year renewal options. (C-30-12-004-3-00) 48. ADMINISTRATIVE CORRECTION TO AMENDMENT WITH THE TOWN OF CAVE CREEK Approve an Administrative Correction to an action taken on August 3, 2011 agenda C-30-11-02-3-02, that approved an amendment to an IGA with the Town of Cave Creek for Cooperative Filings. The purpose of this administrative correction is to correct the acre feet proportion from 1,252 to 1,258 to be registered to the County. All other terms and conditions of the Intergovernmental Agreement remain in full force and effect. (C-30-11-026-3-03)
